Here's the scenario.

My Mom-in-law is the joint sponsor. We will be staying at their house when we move to the US. Please let me know if the following are correct:

a. My mom-in-law only needs to accomplish I-864A since she's also a household member.

b. My mom-in-law does NOT need to fill out I-864

c. My dad-in-law has to fill out I-864A as well since he is a household member

d. I have to notarize the I-864A forms

Thanks everyone! This is so frustrating. We've paid the fees a couple of months ago and still have not sent the AOS forms!

I am in a similar situation to you, although my father-in-law is the co-sponsor. I believe that your spouse (assuming he is the petitioner) needs to fill out I-864, and your mom-in-law needs to fill out the I-864A. If you do not need to use your father-in-law's income to add to your mother-in-law's income (i.e. your mother-in-law alone earns enough to meet the requirements), he does not need to submit anything.

It's such a confusing area to work through, isn't it?!

Im assuming that your husband is the petitioner so he will file the I-864:

a. correct

b. correct

c. correct only if his income will be used to meet the poverty guidelines

d. NO need to notarize.

(the form that I used last March 2010 says no need to notarize but somewhere in USCIS' website says otherwise, I think because they haven't updated the guidelines in their website.)

I've been telling my mother-in-law that there's no need for the I-864A to be notarized but she insists otherwise. Do you guys have a link that I can show her?

its not my interview, its for my mom, it was postponed because of the SPUTUM TEST.

if she still insists, tell her they changed the rule a few years ago. back in 2005 my wife needed to notarize it when she petitioned me but when I petitioned my mom this year the affidavit of support was approved without notarization.

thank you guys for the replies.

my Mom-in-law insists that we have the papers notarized. We had no choice but do it. My husband even got into an argument with his mom. But as you guys should know, never mess with the in-laws.

@Andres: I'll pray that your mom will get the medicals over and done with. Hopefully, no more delays or medications needed.
