Interview letter received today.

Ok so anyone that has gotten a I797C, Noa for interview knows that the list of stuff they want you to bring is pretty extensive. But I just have a question about this part......

If your eligibility is based on your marriage, in addition to your spouse coming to the interview with you,

bring:

Birth certificates for all children of this marriage, and custody papers for your children and for your

spouse's children not living with you.

This might be a silly question, and it might be easily understood by someone that doesn't have a thousand things jumbled in their head at the moment, but yeah that's not me hehe.

Now my question is since I was previously divorced, and I have three children from my former marriage, that do live with me, do i need to bring their birth certificates? What about the custody papers? Me and my ex-husband share custody of the kids, does he need to write a letter for me? Or just bring the parenting plan that we devised for our divorce that happened 3 years ago?

thanks for any help, I hope this makes sense to someone, because my brain has ceased to work for the moment. :bonk:

I think I can help you here...

Im a K1 applicant. citizen of Aust, divorced with 3 kids, who live with me - there father lives in vic Im in Qld and its been like that for over 6 years

I will be moving to the usa to be with my future husband in about a month I hope.

I just sent all my original docs off for the pack 3 today.

I included

marriage certs for the 2 marriages I had previously

and their divorce certs....both originals and a copy

I included my 3 kids birth certificates and copy and of course mine

I also included a STAT DEC which said, I (ex husband) do solomenly swear that I am the biological father of 1, 2, 3, the kids names and dates of birth. That they have been living with their mother at (listed my address) since our seperation and that I am fully aware of my ex wives proposed marriage and that she with the 3 kids will be moving to USA and migrating with my children. I give my consent for this to occur.

then he signed it,

then he got a copper to sign it in VIC

then he took a photo copy of his drivers licence and emailed it through

I can send you a complete copy of the STAT DEC I got him to sign if you like...

then you can add an delete where you need. send me an email

Im assuming that you would need something similiar....good luck

Just to confirm you, the OP, are the USC and no the Aussie. From my reading of your previous posts, you, the USC are the one with kids. The Aussie didn't bring kids (I could be wrong but just confirming).

First, this is gunna sound rude (but it's not I swear) - the interview letter has NOTHING to do with you (the USC). Absolutely zero. You only supply financial support (great huh?) and you WITH the immigrant show evidence of your relationship, but to USCIS, the IMMIGRANT is the one showing the evidence of his relationship with you, and you're just there to prove he's not lying (that's why it says your spouse needs to come, the USC is the "spouse").

So, reading this letter you need to take:

- Birth certs for:

--- any children of the USC and Aussie's relationship (it's strange it doesn't say "if applicable" but whatever)

- Custody papers for:

--- any of the Aussie's kids

--- any of the USC's kids who aren't living with the USC and Aussie

As you said all your kids live with you, I'd probably just bring the custody papers from 3 years ago just to be safe, but the instructions imply it's not needed. Same with any birth certificate etc. Better to have too much than too little.

OP is talking about adjustment of status interview to become a permanent resident, for which the spouse has to attend. For an interview to get a CR-1 (which is what I assume you are asking about) the USC does not need to be present.

Yes Im the USC (op). The kids do live with us. But they are not of this marriage I am in atm. The are of my previous marriage. Ill take their birth certs and just keep them on the side along with a letter from my ex stating they are his. Its funny how the details of the letter come to light when you read it after having it after a couple of days lol. THanks for the help though guys, its nice to know you can come on here and ask silly questions to help your head get straight again.
