Travel to US while waiting for K1 Interview

Hi all,

As stated on another forum, my fiancee's K-1 Interview is scheduled for Aug. 16 2010 at Montreal (she is from Canada).

Question is this:...

Before her interview, we’re planning to leave from Toronto, Canada on 8/2/2010 to go to Mexico. From Mexico, we’re returning to the US (i.e. NY) on 8/6/2010. Even though she won’t have her fiancée visa at the time, do you think she’ll have any problem entering the US (i.e. as a Canadian citizen/visitor) for about a week's time? I don’t know if she would show up in the US immigration system as “immigration visa pending” or etc. The plan is for her to return to Canada the following weekend.

If shes a visitor who hasn't overstayed her welcome (like stay in US for 89 days then leave a for a few days or couple of weeks...only to return for another 89 day run) she should be ok. What I mentioned previously is what INS is looking for at the moment. I hope this helps.

Travel to US: Aug 19th

Marriage: Sept 3rd 2010 !!

AOS/AP/EAD: Sent Sept 20th

NOA 1 (for all 3) Sept 30th

Biometrics appt: Oct 27th 2010

AOS interview: Dec 15th 2010

Timeline

Hi,

She should always carry strong proof of ties to Canada with her, whenever entering the U.S., like a letter from an employer, stating when she is expected back, a lease or mortgage papers, bank statement etc.
