I beleive you are supposed to file tax returns even if you did not work. You can always file them and fill in zero for it all. There is no penalty for filing late if you do not owe the government. Good luck.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

You can also go to the IRS office and request a "verification of non-filing" to prove that she didn't file taxes for the years requested on the RFE.

Also, for the papers you sent in, make sure you send the W-2s & 1099s, not just the actual tax forms (like the 1040).

If no income, you don't have to file. It's okay not to file, as long as you don't hit a certain threshold - something like $6,000 or so.

For most people, if they had wages less than $9350 then they are not required to file a return. There are exceptions, such as self-employed people with earnings over $400, or someone who sold a home, etc. People with wages below the required minimum sometimes choose to file in order to recover taxes withheld or to claim a tax credit they qualify for.

Smarty, have your wife write a simple letter explaining why she did not have to file; i.e., she wasn't working and did not have enough income to require a tax return filing. Did your co-sponsor send a return or transcripts for 2009?

I know a couple of people who have done that (myself included) who then have gotten RFEs for it anyway. That's why I suggested the verification of non-filing from the IRS.
