Hello everybody

I am sorry for opening this topic but I couldn't find any related topic in the forum that would answer my question. I'm preparing the I-864 and I know that it required 3 years incomes. However, I've read numerous posts saying that the current and latest income are most important. For my current income I've put down what I'm earning this year which is around 33k. For 2009, my income is about 30k. In 2008, my income is around $26k but I was self-employed that year. Thus, the adjusted income after tax deduction is around 12k which is way below the requirement. And here is my questions: should I included 2008 income into my form? Do I need a co-sponsor for my case (this is worst case scenario)? and if I included 2008 income and also submitting a document explaining all the tax deduction, would that help my case? Thank you so much for your time and consideration.

PS: My wife is in Vietnam.

PS: My wife is in Vietnam.

It says on the instructions that you can include EITHER 3 years OR 1 year of back tax returns. 3 years is NOT required.

Are you only sponsoring your wife? If so, you just need $ 18,212.00

Here is teh Poverty Guideline from the USCIS to get the proper figure.

For our AOS, my husband just submitted his most recent tax form for 2009 along with his W2.

I think you should be able to put the 2008 income even though it is below because they just want to see if you have filled taxes and if you are able to make the money to support your relative. Just make sure you put the necessary documents like 1099.

Hi,

Some of this stuff is consulate specific, however in general:

- If you send IRS transcripts you do not need to include slips like W2s and 1099s. If you send in the actual tax return(s) then you must send in the slips to support that.

Don't worry too much about 2008. First of all you are only required to send the latest tax return (2009) - however the future immigrant should have the other two years with them at the interview, in case they are asked for.

They just look at past returns if they want an overall picture of your financial history - again, don't worry too much about the 2008 return, your current and 2009 income is more than sufficient.

Im a bit confused, Does self-employed income need deduction form their toltal income? How it calculate?

I made around $26k that year. But I just started my business that year also; thus I needed to buy bunch of equipments and spent a lot as business expenses. And I subtracted those expenses from my total income. In the end, I only made around $12K net profit.

the minimum requirment is based on gross earnings not net. so your fine

10-26-2010: I-130 approved

01-05-2011: SIF & CC

04-28-2011: Interview date April 28,2011 @10:00 am APPROVED
