Hi VJ Family..

Just want to share info and also seeking support from VJ family.

My fiance went on to interviewed yesterday on 7/8/10...Here's what she tell me FYI for those will be going through this painful process in the future. After hours of waiting for your number to be call into a glass room where she'd stand and 2 CO in a glass room (1 Caucasian 1 Vietnamese "translator").. She was nervous (only natural if you're human), but handle very well in my humble opinion. Interview time was ~20 minutes.

Question 1. - How, when, and where you first met? Answer - Great - correct-o-mundo..

Question 2. - Your fiance occupational? where/what/how long? - Answer - Correct.

Question 3. - Your fiance education background? where? when graduate? - Answer Correct again.

Question 4. - Your fiance address? How long he lived there? - Answer Correct part A. Wrong part B (How long) :bonk: (that's my fault, I thought I've cover this w/ her , but apparently I didn't..

Question 5. - Any relative in USA? where do they live? How far are they from your fiance? - Answer Correct on A & B.. Wrong in C she's doesn't know geographic distant minutes from city to city that well (i don't think big problem here)

Question 6. - Did you have engagement ceremony yet? Do you have marriage certificate yet? - Answer Correct & Correct

Question 7. - What type of petition did you fiance file? - Answer I-129F K-1 FIANCE.. YES..

Question 8. - Do you know what to do after entering USA? - Answer Correct - Civil marriage within 90 days.

Question 9. - Did you have any plans for wedding? honeymoon? If so, where? - Answer Yes.. Correct..

Question 10.- How many time did your fiance visit you? - Answer - 1 time.

Question 11.- Does your fiance live by himself or with anyone? - Answer - by himself.. Yes.

Question 12.- Does your fiance know your relative in USA before? - Answer - YES

Question 13.- Were they on the same plan traveling back to VN? - Answer - YES.

Question 14.- When/Where/and How did I propose? Did you accept right away? - Answer. Correct.

Question 15.- Who and When did your fiance came came to USA with? How?[/font] - Answer - Correct part A.. "I don't know" for part B. :bonk: my fault again.. we never discuss this.

That was the last question before they handed her the BLUE letter w/ a NEW APPOINTMENT DATE FOR RESUBMISSION OF REQUESTED DOCUMENTS which is exactly 1 month after.

Reason for BLUE is SECTION 221 (g) - fail to present documents required.

*Petitioner: in a sworn, notarized statement, please provide a detail chronology (timeline) of your relationship.

*Petitioner: In a signed,sworn, motorized statement, please list your current residential address and telephone numbers, including all resident for past 10 years.

From what my fiance told me, they only gave a quick glance to any/all evidence you brought. Some were even omitted. Even my 2 page time line that I've sent her. 1 page is bullet style columns w/ date and place. 1 page is brief description of some significant date, signed, and notarized. Also just a glance.. which is why I'm at lost. Not sure what I gotta do now...

Please VJ family... I'm asking for your help me once again.

I am sad at this. Just do as everyone said and submit the additional info. Everything will be fine as this is just another bump and not the dead end. You knew going in there were red flags and pretty much what they were. I also made only one trip and had a short period before engagement. I managed to get a pink. God bless you both and good luck.

Going to the consulate on Tues or Wed afternoon as the USC will not get you to the CO.. only soneone to talk to who will not give you many answers if any.... getting to talk to the CO as a USC is almost impossible...

I disagree and am evidence of that. I walked in during USC hours and they pulled my case and interviewed me. U was sent away with the reason that they need to review my case further, but I got our case looked at, and it ultimately approved.

After the denial, we were initially planning to get a marriage certificate in VN and file for the CR-1 since then we wouldn't need to wait for anything from Immigration Services. We had done an "unofficial" wedding ceremony already for her family in VN so the fiance visa was supposed to just be for the official wedding in the States. Oanh got nervous and didn't explain this very well in the interview so I'll have to practice more with her next time.

Anyway, I still flew back there again for us to have a honeymoon vacation together a couple months ago but now our plans are leaning towards refiling another K-1 petition later this year after we get the notice of denial. I figure that the notice should be coming in soon since it's been a little over 5 months from the 2nd interview and the case had finally returned back to USCIS in late April/early May.

During my last trip, I visited the consulate and the worker there told me that a new fiance visa petition would be reviewed fairly without an automatic rejection from having that first denial. Thus I'd need to address the issues raised in that denial letter, namely collecting more evidence of time together and having a clearer explanation of our wedding/honeymoon plans.

Our other red flags seemed to center around us rushing into the proposal and engagement ceremony on my first trip to VN, but I can't go back in time to change that particular issue. Getting a VN marriage certificate might solve a little of their suspicion of a sham relationship, but it will be awhile before I return there so we'll likely go with the option of refiling for the fiance visa. This time I'll include the new evidence of our time together and maybe some other shared commitments like a business venture we're hoping to get into soon.

I know this next petition will be another rough road but even in the worst case scenario of getting denied again, we both feel optimistic that we'll be together eventually. Gotta stay positive!

Ah, somehow I assumed those workers at the glass counters were also the ones that reviewed the cases. When I was originally planning to go in myself after getting the blue slip, my fiance told me this wild story of her friend whose husband had gone in to ask about their petition. He ended up talking to the CO assigned to his case, but then the CO basically started grilling him with questions about the wife's family and they ultimately had their case denied. Yeah, the story seemed far-fetched to me, but my fiance was so afraid of me going in there because of it that I caved in and left the matter alone after notarizing the requested docs.

Anyways, I finally did go to the case inquiry period on my last trip there and it's similar to how you described it in that they won't answer much. But it may still get noted in the records each time the USC comes in to officially inquire about his case as we have to fill out a form each time. That's got to count for something positive if each consulate visit is saved in the case file, especially if someone were to bring extra evidence with them to add to their file.

Maybe the husband gave contradicting info... :P

When they asked me questions, I was real nervous too. They asked me questions related to me, and I gave them honest answers, but they were the kind of questions/answers that could have bitten me in the butt--half of it anyways! I was asked about my job and my current living situation. The job question was straightforward. It was the current living situation that could have possibly gotten us a denial. I have a guy roommate who happens to be my brother's best friend; he also happened to go back to Vietnam with my when I got married. Ultimately, in the end, I asked him to provide us with an affidavit of our bona fide relationship. He still lives with us.

Ronnie is also recent proof.. as I just found out that he was able to go in enough times to get a person willing to open a folder... I and many others were not as lucky...

Look on the bright side, you have a chance to correct your first mistakes so do it. Fiance visa is very hard to get approved and is easily rejected. If possible go to Vietnam to the Consulate before her interview and have your visit recorded. Anything you can do to help would be great. The last thing you want is for it to be kicked back to US because then you have to refile so you are another year plus before she will interview again

My ex-wife was deceased last year and I had submitted the death certificate with the petition package. Should I show her current address is 1 Jesus Place, City of Heaven, North Pole (I assume that Jesus and Santa Clause live together)??? j/k.

My questions are that the CO seemed to ask for these information if the case falls under the relationship is short then require timeline, the petioner and benificiary have ex-spouse then require their current address and proofs. Do you think these are boilerplate reasons? When you resubmit the necessary documents on the specified date, does the CO review them immediately on that day nd let you know the outcomes or you have to wait for the notification letter? I will come back to VN and be there with my fiance to submit those documents. I am so stressed out because from reading some of your cases, we might head toward the AP or the worse outcomes. Any comforting suggestions will help me tremendously. Thanks.

They may review them the day of the next appt. or they may issue another blue and look at them later.. it all depends on the CO and what they think of the case right now... In this case if the USC is there they can go and take the docs ahead of time and try to talk to the CO before the date asking questions to see if there is an issue and go back on the date indicated on the blue slip... if the USC was married before they often issue a blue the first go and look a little deeper... IMO its a good sign that they did not ask for additional evidence of a bonafide relationship, but that could also be a trap in that if they did not look at much evidence at the interview they can say there is little evidence of a bonafide relationship.. talk to your fiance to see what they looked at... if there is a chance that they ignored a great deal of evidence... that evidence can be submitted on a Tues or Wed afternoon by the USC to avoid them using it against you.. they refused to look at our evidence at the interview... I took it in and made them take it to look at it and not it in the case file...

Keep in mind we are dealing with a beurocracy here... I heard a joke the other day.. went something like this:

If a beurocrat jumped out of a window on a building, it would likely take more than a week for them to fall each floor toward the ground, because the way they do things defies any logic or rational expectation. :blink: Nothing involving these people happens at a normal pace...

Thu is telling me that she is hearing about more cases resulting in Blue Slips with the "address for 10 years" as one of the reasons. This has to be a new tactic they are using. I understand that the Consulate can do background checks and find things about your living situation that does not add up but to see this address thing come up more and more on Blue Slips tells me something more is going on. I still have a chance to check on some things before I file the I-129F next month. I met Thu while I was still living with my parents but moved to my own place in February this year so I will make sure my address was changed completely. I have a few good things about my case though. Thu and I have never been married and we were not introduced by any relatives. In fact, she has NO relatives in the U.S and I have no relatives in VN so we do not fall into any of the "classic" fraud categories so this gives me a lot of hope that we won't get blue slipped for this. But I have to admit, this is one extra thing that worries me a little. Gosh I just want to submit the darn I-129F and forget about all the worries :)

Carrick, On the upside it takes alot less time to get to the consulate than it did when you first thought about filing.. Your case will be so much better prepared now than before!

The address thing is just one more document to work on ahead of time in case they ask for it...

Anyone married before should expect to get a request for evidence of the former spouses living situation...

I think the Time line and 10 year residency is awesome, I turn mine in during the NVC stage and it got accepted, so therefore i 'm thinking that what caused the approval so quick and painless. its also help that the person that introduce us lived in the middle of the pacific, and i've never met her. And doing a proper Dam hoi and Dam coui would also help seal the deal. Please dont do the dam hoi at a restaurant, it against tradition i'm telling you.

These are the questions that my fiance remembered:

How did we meet?

Who introduced us? How and when do we know her?

What is the highest degree that I hold? Where and what year

Where do I work now? Who is my boss? Who are my co-worker (they wanted names)

Did I get married before? How did my marriage end? What and why did my wife die?

How many kids do I have? Names and how old?

Wedding plan? Honeymoon plan? My fiance answered that we plan to go to San Francisco

What does San Francisco have? How do you plan to travel there? How many hours will it take to drive to San Francisco from my house?

Did my fiance get married? How did it end?

How many times that we met? Did we have an engagement ceremony? How many people attended the engagement? How came back with me to the engagement?

My fiance answered everything correctly. They took a glance at the pictures and some other evidences and return everything back to her. They kept the copy of the required documents. She said that she saw a pink piece of paper with her name but at the end, the CO pulled out the BLUE.

Is there possibility that they just need this additional information just because we both married before and our time knowing each other was short. I met my fiance in December 2009, proposed to her two weeks later in January 2010. Submitted the application in February 2010, and came back and had the engagement ceremony in April 2010. It was a big event because my fiance's parents would like to do it as a regular wedding with all formal and traditional ceremony. Hopefully, they just need to documents just to have in our file and then issue a PINK. Can anyone provide some detailed information on what happens on the second appointment?

Did she submit photos of Dam Hoi?

The red flags of short relationship before filing and 1 visit before filing.. are big flags to the consulate and they like to throw blue slips in the mix to give them time to look deeper...

something in the interview caused them to take a second look... who knows what it was.. it could have been a response or body language.. Jeromes Fiance also saw the pink and they got the blue...

The CO did look at the photo from our Dam Hoi as well as other pictures. I don't know what could be the red flags since she answered all of the questions correctly. Both of us are devastated in getting the BLUE and don't know what happen next.

From the very first time the two of you met each other......................to the time you decided to file the petition = less than 1 year. And you expect a Pink slip? I'll let you figure out what's wrong with the picture I just pointed out.

I'm not responding to anyone in particular. If you rush your relationship, expect bumpy road ahead of your journey.

Edit to add: do you know how many thousands of times the CO already heard of the love story "Oh, as soon as we met each other, we know we're meant for each other and I simply can't wait another day to file the petition"?.....................................................and then soon after she's got her 10-year green card, poof, there goes the love. The CO heard it all.

Just remember, life over there in VN is NOT real! Your money will be worth a LOT less once you get back over here. Back to reality, cowboy!
