My husband & I are trying to start filing are visa, we just recently received are marriage certificate & now want to get the process started. He's American & I'm Canadian

I've spent months researching the visas & still a little confused on certain areas. I have a few questions though before we began:

Such as do I file the I-130 in Canada at the embassy or does he file it in the U.S & if so does he file it at his local service center or his local Chicago Lockbox?

Also I was reading on the government website that you can also file your I-485 at the same time as the I-130, does anyone know if this makes it easier or if it actually complicates it, or if it even makes a difference?

If the USC is resident in the foreign country he/she might be eligible to file it at the foreign consulate. If the USC is resident in the USA, then it is sent to the USCIS via the address in the form instructions.... (hint: Chicago)

The I-485 can only be filed if the alien is present in the USA AND the alien entered the country as a non-immigrant.

The I-130 is a petition for an IMMIGRANT visa. So no I-485 would ever be required if you enter on that visa

It says on the govt website that you can file the 2 together but I haven't read anything more about it.

You can but you would need to already be here in the USA..... it is a totally different process than the process for the visa
