Hello All,

This forum has been a great help of mine since I started my journey in the USA. My husband petitioned my daughter (6 year old) this may. We got notice that USCIS got our petition and that's all so far.

Due to my pregnancy if the petition is done for November, I will not be able to go oversees and bring her here.Even if I have a little baby by the time petition is sent to my country I still would not be able to travel with the baby.

However, I know that if a parent is not in the country, she will need a permission from me to come to USA. As far as I understand I need to sign some sort of document that would let my mother to bring my daughter over here.

Does anyone know where can I obtain this document? Here or at the embassy in my country?

When should I start doing that document?

I am so nervous because I won't be with her at the embassy but I hope all will go well.

Please let me know if anyone has been in the same situation. I am pretty sure someone would have done the same route but I can't find it in the posts here.

The document can be prepared by a lawyer here in the USA for example, or even do it yourself, of course if you feel comfortable... it is not something the Embassy or consulate does. It really does not take much time to do it, so get it prepared anytime prior to when you need it and you know all the details of the trip.

Should I talk to immigration lawyer about it?

Do I have to send it to NVC while submitting all the necessary documents?

My husband is dead, so I am the only one who gives her the permission to travel without me from the country...

NVC does not need it... might be needed by the consulate, but most likely it will not be needed until they are departing the country (ie. airline and exit passport control).

This does not require an immigration lawyer... even a general law practitioner can do this

FWIW, I did something similar for my wife to travel with my daughter myself with a little research

Oh , I thought NVC needed that, since she is a minor. I may as well send an e mail to the embassy, however, I know they are not very efficient on responding.

I read somewhere that ppl were sending some sort of documents( similar what I mentioned ) to NVC but I might be mistaken.Thanks for your information. I would guess my country would need some type of documentation for sure at the airport. I have no clue where to find it but hopefully by that time I will find some answer.

If it is needed for the issuance of the visa, it would be needed by the consulate. NVC does NOT issue the visa... the consulate does. If NVC is concerned about the other parent's rights... They could ask for it, but the biological father's death certificate would satisfy them as well.

This is not necessarily a form you can find on the internet, download and fill in the blanks. To be most effective, it is a legal document that is created and personalized to you facts and situation

I know NVC doesn't issue visas .But I also know that NVC does not make the case complete if some doc. is missing. I wanted t o make sure that I didn't need this document at NVC stage.

So I have to have it at the consulate when she will be having an interview. Thanks for the info. I will start doing research about it in my country too.

Not yet. When we filed I-130 they didn't ask about it. However, I do know that they will require her father's approval or death certificate at NVC and at the embassy too. When I was having my immigrant visa interview, I saw a little kid who submitted father's approval(notarized).One also submitted father's death certificate.

What the NVC will want is permission from her biological father to immigrate to the US.

Well , father is dead. I have certificate here and I can send it to them upon request.

Your document for the NVC will be the biological father's death certificate...

Your document for your child to travel with someone other than you, will be a notarized permission document granting that permission and most likely a copy of the death certificate.

As you see I am from Georgia close to Ukraine.:)

Laws change quite often in Georgia, but I do hope I will find the "right" notarized document for the airport.:)

My wife had a Ukrainian lawyer draw hers up for her son.... but she was still in Ukraine at the time. I did mine myself for my daughter.
