New Here and About to Start My Filing - Would Appreciate Input

Hello! :)

I am a US citizen and have been married to my husband for 1 year and 7 months, and we both live overseas in Panama (Central America) since before we were married.

We have now decided to get his paperwork filed for us to move to the US and will be applying for the IR-1/CR-1 visa.

I did have the following questions, any and all input is appreciated...

1) Approximately how long has this process taken for most of you from the day you filed the I-130 to the port of entry date?

2) If any of you lived overseas, did you encounter any obstacles in filing your I-864 Affidavit of Support? That is, since you were overseas, did you encounter any issues when trying to establish your domicile back in the US? How did you handle it?

Dec-15-2008..... Got Married!

Aug-20-2010..... Filed I-130 at U.S. Embassy

Sep-15-2010..... NOA 1 Received

Sep-23-2010..... Packet 3 Instructions Received from U.S. Embassy

Nov-19-2010..... Packet 3 Handed in to U.S. Embassy

Nov-19-2010..... Packet 4 (Appointment Letter) Instructions Received from U.S. Embassy

Nov-20-2010..... Medical Examination Completed

Dec-06-2010..... Interview - Visa Approved!

Dec-13-2010..... Visa In Hand!

May-02-2011..... Port of Entry - IR-1

May-16-2011..... Social Security Card Received

May-21-2011..... Green Card Received

Probably best to file your petition directly with the Consulate. We have a forum specifically for "DCF" (Direct Consular Filing) Domicile can be a tricky issue but that and the I-864 are separate issues. Start with the DCF guide by clicking on the word "Guides" at the top of any page here.

We are actually going to be filing everything through our US-based lawyers. We can use the extra time it would take doing it that way to our advantage.

In regards to the domicile and I-864, what has your experience been with that?

We're going through the process and the lady told me it would take 4-6 weeks to process, it might be different in your country. I think the longest it would take is 3 months, from what I read in the guides.

If you worry about re-establishing domicile you can prove you intend to return by showing proof you have kept a driver's license up to date, kept up voter's registration, recent bank statements of accounts you've kept open in the states. Copies of these might be helpful. :)

Also if you have found work or have a house/apartment you are going to, show a copy of the contracts.
