I-485 AOS Still Pending forever

Timeline

My wife came in United States as K-1 Fiancee Visa, last July 2009. We got married within 90 days, September 2009. We filed I-485 AOS together with her EAD, November 2009. She received a receipt and appointment for Biomeric Scan, December 1, 2009. She got her biometric Scan, December 24,2009. Then on February 1, 2010, She received her EAD card. Then we never receive anything from USIS. Now its July, 2010 case is still pending. We've keep calling 1-800 uscis number but then they couldn't even give us definite answer on why I-485 is still pending. We've been to the USCIS field office but then still we got same answer. What are we going to do now? How long should we wait? We are so confused.

Anyhow our I-485 AOS was transferred to California processing in Laguna Niguel and we lived here in California.

Any advise? please help?

Should we have to wait for a year? It will be 8 months from now since we filed the I-485 AOS.

Hi Richey,

I am nothing more than a sympathetic ear. My husband and I have a very similar timeline... we applied for his AOS on 4-November and our case was transferred to California on 24-December. We called the 800 number, and they said that there are no defined processing times for AOS based upon family status. With that said, our application is probably just waiting with yours.

I hope we both get our approvals soon.

Im sorry to hear that. I heard that some AOS processing will really take time, they transferred mine in Laguna Niguel too and it only take 4 months.

Just pray it will come soon... :)

Have your local Senator/Congressman make an inquiry. I've seen most CA couples get interviews but you should have received something by now.

01/2006 - Filed k1(1st time)

04/2006 - Interview (1st time) denied

Waited, waited...... no review

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

04/2010 - Married

AOS Timeline

4/19/2010-Sent to Chicago Lockbox

4/26/2010-Received texts and emails 7th day

4/30/2010-Received NOA's(Hardcopies) 11th day

5/3/2010-Received ASC appointment notice(mailed 4/29/2010)14th day

5/7/2010-Walk-in Biometrics done(2 weeks earlier)18th day

5/13/2010-Case transferred to CSC

6/2/2010- Case received/resumed at CSC

6/18,6/22,6/23 AOS touches

6/28/2010- EAD production and touch on AP

6/29/2010-AOS APPROVED

7/2/2010- 2nd update on EAD production and touched on AP....

7/6/2010- Received "Welcome Letter" and AP document

7/12/2010-Received GREEN CARD and EAD

Have your local Senator/Congressman make an inquiry. I've seen most CA couples get interviews but you should have received something by now.

Yes. Sad to say, they even got their green card even without having an interview. One of my wifes' friend who just filed I-485 AOS this March, Got her biometric scan on April and waited only for a month and then she got her Greencard June 2010.

Well in our case we never received an appointment letter for interview neither any letter that required supporting documents or evidences. Well, we make another schedule for the uscis field office to follow up on what has been going on. This will be the second time that we will be in the uscis field office again. And if we got the same answer probably we will see them every once a month. We are not that in a hurry but then at least we want to know what has been going on.

Sooooo frustrating!!!!

Thanks for the reply. I thought we are the only one who is drifting in this kind of case. I couldnt figure it out how sometimes they even release GC even without an interview. One of my wife's friend, who came here in California just like my wife, a K1 fiancee visa holder but then to think she filed late and she just got her greencard last month without having an interview. So frustrating!!!

I understand that it is not only us that they need to process but then at least they let us know what has been going on...or where are we in the processing??? or they process it or not. Neither they send us any letters of whatever documents or supporting evidences they need.

Well I would be probably seeing them (uscis) every once a month if I still got same answer again.

Good for you...and I am happy for you too.

But for us who is in this waiting list is not a happy experience at all. It is so frustating. Everyone wish to have a faster processing but that doesn't happen to everybody. Well you are right just pray till miracle comes. And hopefully they will have to glance our papers. Thank you for the reply...You know it helps when someone listen to your agony. It is like there is somebody out here who listens...

My AOS took horribly long, too (just got my GC at exactly one year after filing), but I found that asking our Senator's office to assist us with the case helped a lot.

I kept calling USCIS and making Infopass appointments, and no one would tell me what was wrong with my case; once we got the Senator's office to inquire for us, we got somewhat of an explanation of the situation, and they started processing the case again less than one week after the inquiry was made.

I kept calling USCIS and making Infopass appointments, and no one would tell me what was wrong with my case; once we got the Senator's office to inquire for us, we got somewhat of an explanation of the situation, and they started processing the case again less than one week after the inquiry was made.

WOW!!! really. I should have to do the same thing too. Did the uscis give you the reasons on why your AOS took so long to process? or did they require you of supporting evidences or interviews?

I agree with everyone who suggested asking help from congressman or senators. i just got my gc in the mail yesterday and will heartly thanks to our congressman.please check my profile and my old posts if you need some advice on writing your congressman.i wrote there all the details of what ive been through waiting for my aos and i hope it help you too.

did you also try doing an infopass? our case was transferred to CSC around jan.28 i think and my CG was approved feb.22...i even had an RFE

but my friend applied for theirs in jan i think, got transferred february and nothing still.. not even her EAD

but i will pray for you that you'll hear some news soon..

hi, i had the same situation before as your wife does, almost the same month when we filed for my AOS last november 2009, i kept calling the california service center three days in a row after my 6 months of waiting, then guess what, after 12 days i received a welcome notice and in june 10 i received my greencard. mine was also transferred to california without interview and rfe, it wont hurt to keep calling, the answered i always got from them is my application is out of processing, and told me to wait. but still i kept calling eventhough ive got the same answered, lucky enough im done waiting.

The USCIS said they needed to perform additional background checking on my case and that's why it was taking so long. Later we found out that someone had written a letter to USCIS claiming our marriage was fake and that was the reason for the additional background check. Few days after the Senator's office inquired on our case, we got a surprise visit from ICE, and a few weeks after the visit we got our interview notice.

Anyway, mine was such a weird situation, so in a way I can see why it took a whole year.

I'm sure your case will be faster than that! Best of luck with it :)

Yes we did last month. And we will have another schedule again. And if we would have to get same answer again, we would be probably seeing them at least every once a month.
