Conflicting K-1 instructions/DS-230 Part 1 from Bogota

For Packet 3:

'Instructions For K-1/K-2 Visa Aplicants' from Embassy in Bogota:

'Part 1': "Second: As soon as you have obtained ALL the documents..., you must complete and sign Forms OF-169 and DS-230, attached (Part 1 on DS-230). Send these forms to the Embassy...." English Version.

OK, they say to sign both OF-169 and DS-230 Part 1. However, on Form OF-169 they say: "Also attached: Form DS-230 (Completed but not signed)" on English version of OF-169. The Spanish version of OF-169 does not say 'completed but not signed,' only "Adjunto: Formulario DS-230."

Should my K-1 fiancee send the DS-230 Part 1 signed or not signed(along with OF-169)? I am leaning toward signed.

I understand the DS-230 Part 2 brought to interview should not be signed before the interview.

This question is only about the DS-230 Part 1 sent to obtain the interview.

You're actually reading old information as the OF-169 is no longer accepted by the US Embassy in Bogotá. It has been changed to form DS-2100.

Here are the instructions they have on their web site:

As soon as you have obtained ALL documents required to process your case, you must complete and sign the attached Forms DS-2100 and DS-230 Part I (Application for Immigrant Visa and Alien Registration – Biographic Data). You're actually reading old information as the OF-169 is no longer accepted by the US Embassy in Bogotá. It has been changed to form DS-2100.

Here are the instructions they have on their web site:

As soon as you have obtained ALL documents required to process your case, you must complete and sign the attached Forms DS-2100 and DS-230 Part I (Application for Immigrant Visa and Alien Registration – Biographic Data). One DS-2100 is required per petition. One DS-230 is required for each applicant.

Normal logic caused me to assume the instructions seeming most specific to my K-1 case, the K-1/K-2 instructions, were the ones we should follow.

So, they would have rejected the Declaration, as OF-169, if we had sent that versus the DS-2100(?) Unbelievable! Maybe I will phone Bogota tomorrow and be lucky again to get to speak to someone about the rat's maze of conflicting "instructions" on their site. When I spoke to IV unit in BOG 6/23/10 (to se if had received case file from NVC), I was certain they confirmed that we should use OP-169 together with DS-230 Part 1.

The only day you can get a hold of someone at the US Embassy in Bogotá is Wednesday from 2-4 p.m. It's best to send them the latest version of any document they request just in case. All she has to do is print a new one from the DOS web site and send it over to them. The fastest way to get all those documents to them and get an answer is by scanning the forms and e-mailing them to the embassy.

My fiance faxed (using fax number given on DS-2100, from inside Colombia) the DS-2100 and DS-230 Part 1 to Bogota on 7/12/10. On DS-2100 she gave her email address. We thought the embassy would have sent her confirmation of receipt of the fax, but they have not. On 7/19/10 I phoned Dept. of State and they checked the system for me: the receipt of our Package 3 forms has not yet been logged into system. D.O.S. advised to call back every several days (DOS or embassy on Wednesdays).

Is this normal for a fax to the embassy (with Package 3 forms to initiate interview scheduling), if sucessfully received, to take this long to be acknowledged at least by being entered as received in their internal system? I'd hate to wait a month to find out it must be sent again.

Solved: Called DOS in USA again. They said fax received and interview scheduled for August 2. There is a long wait to get through the DOS number, but well worth it.

We Sent our fax of Ds-2100 and DS-230 on July 15th, I tried in vain to call them yesterday (Wednesday) during the 2 hour window, that was a total waste of time, got through 3 times and each time I was transferred from the operator to someone in Visas I ended up in Limbo for 30 minutes, then disconnected.

I finally had success in writing to the embassy and they basically believed me when I told them I had the fax Confirmation (which I do) but they still could not find the documents. So lesson to be learned, Scan the Documents, save as a pdf file and ask them to verify in a response e-mail that they have received them.

So lesson to be learned, Scan the Documents, save as a pdf file and ask them to verify in a response e-mail that they have received them.

That's what I did and it worked out well - I had an answer in less than a half hour. :wow:
