Does US spouse of Indian passport holder need visa?

So from the sound of it, it's best to just have my husband, the USC, apply for a PIO. We'll be married one year this August and I think he'll be eligible for it then.

Thanks for this 'entry visa' tip--had no idea!

Is there a clause that you have to be married for at least a year for your husband to be eligible for a PIO card? If yes, then my husband won't be eligible right now, since we got married in February this year.

My head is spinning :wacko:

AOS timeline:

1st March 2010 - AOS packet received at Chicago (I-130, I-485, I-131, I-765)
9th March 2010 - Checks cashed
12th March 2010 - All 4 NOA's received
19th March 2010 - Applications touched biggrin.png

21st May 2010 - AOS Interview, IO said he will approve the case... waiting for Green card smile.png

17th June 2010 - Approval notice for I-130 received. Also received "Welcome to USA" letter biggrin.png
28th June 2010 - Finally received my GC.... Praise be to God smile.png

16th March 2012 - Sent ROC package
21st March 2012 - NOA1 date
20th April 2012 - Received Biometrics letter for 16th May

December 2012 - Received 10 year GC

01 Nov 2013 - Sent naturalization package

18 Feb 2014 - Oath ceremony done, naturalization complete!!

Hmmmm.... I see that requirement. I'm planning on calling the Chicago office today to get some clarity around the PIO and entry visa requirements. If I'm able to get a hold of someone, I'll post an update here.

Daniel is the USC and he has a 10 year valid tourist visa that he has used 2 times before to come see me in India. Does he need to get a different visa now? What kind of visa would our son need?

Parul you should look into OCI for Adi. As he qualifies for that being a child of Indian citizen. It is a bit expensive but in long run he can come and go out of India any time and stay for as long as he wants to without going to authorities every 6 months (as that's the requirement for PIO).

Here's the relevant clause--

Those applying as spouses of persons of Indian origin should submit original Indian passport or PIO card (whichever is applicable) of the spouse and original marriage certificate; (To be eligible the marriage must have taken place more than a year before the date of application)

Ok, noob question--As a CR-1 GC holder, I can still enter/exit India with just my Indian passport, yes? I'm beginning to get confused. I don't need a PIO/OCI until I apply for USC (if and when I do), correct?

Ok, noob question--As a CR-1 GC holder, I can still enter/exit India with just my Indian passport, yes? I'm beginning to get confused. I don't need a PIO/OCI until I apply for USC (if and when I do), correct?

Yes you can enter and exit India with your Indian passport as long as you are an Indian citizen. Do keep your GC handy while exiting India coz you will have to show that to the custom/border security guys.
