I came to visit my bf in texas in june. While i was down here he asked me to marry him when we go on vacation with his family to galveston in june/july. We got married :P Anyways what i am trying to find out is can i just stay here and file the k3 visa or will i have to take my return trip at the end of my 3 month stay. I am really confused on what to. I find so many diffrent things over the web. So if any one can help me out that would be great.

K-3 has been made virtually obsolete by NVC, so you would be better advised towards a CR-1 if you wanted to go that way. However, you will have to leave the country at the end of your stay and complete processing from Canada. Alternatively, you could stay here and adjust status - you can NOT leave the US while this is in process. AOS is quicker (especially considering how slow the Montreal consulate is), I applied for it at the beginning of May, and my interview for the green card is July 29th. Some have not gone so quickly, but what we've seen lately is, in general, 3 months from application to GC receipt.

Not only do you not have to leave, you CAN'T leave laughing.gif. At least, not until you get your approved AP (Application for Travel) - suddenly, it occurs to me I don't know why we call this the AP.

For AOS, you will need a copy of the entry stamp in your passport, and the I-94, if they attached one. This proves that you were inspected by a border officer when you entered the country. You won't necessarily have an I-94, but you should have an entry stamp - I know they don't always stamp your passport, and I don't know what you would do in that situation.

Would you also know the fees it might cost to do the aos

No, you can't work. Two government fees for AOS, $355 and $1,010 and a fee to a Civil Surgeon for the medical exam. Please do yourself a big favor and carefully study the AOS guide. Then download the applicable forms and study their instructions carefully. You'll be glad you did.
