We could miss filing our AOS by a few weeks past our K1 expiration.

How bad is it if we file a few weeks past the expiration ?

Please let us know.. thank you :)

K1 timeline :

1/11/10 - I-129F sent to California Service Center

1/19/10 - NOA1

2/18/10 - moved and changed address on USCIS site

2/19/10 - touched

3/10/10 - touched

3/10/10 - NOA2, hardcopy recieved 3/12

3/16/10 - Left NVC, recieved MNL case #

3/22/10 - USEM recieved

4/19/10 - Passed Medical

4/28/10 - Interview - Approved

4/30/10 - Picked up Visa and completed CFO

5/5/10 - POE - Honolulu, Hawaii

5/6/10 - married in Hawaii

AOS timeline:

7/8/10 - received SSN Card

7/16/10 - reported US marriage for RP records

10/18/10 - AOS delivered in Chicago

10/25/10 - NOA1

11/04/10 - Biometrics Letter Received

11/23/10 - Biometrics Completed

11/24/10 - touched

11/26/10 - touched

02/14/11 - AOS approved at Interview, GC ordered

02/22/11 - GC arrives in mail

ROC Timeline:

12/17/12 - I-751 sent to California Service Center

12/20/12 - NOA1 arrives in mail

1/14/13 - Biometrics appointment

4/11/13 - RC Approved at Interview

4/22/13 - 10 Year Green Card arrived in mail

sorry, is no Regulation on 'when to file'.

Is only Regulation to get married within 90 days of POE.

If you are reading something, please post it here, let us vette your data , for you ?

Most ppl are OK when filing 6 months after POE.

Many people have trouble 2 years of waiting, so don't wait 2 years, ya ?

Specifically for yer question, where 0 is not bad, and 100 is bad - you are at

0.

It won't affect your AOS at all. The general requirement that an alien has to maintain their non-immigrant status to be eligible to adjust status does not apply to immediate relatives of US citizens. Any encounters with immigration officials might be more complicated than you'd care to endure, but unless you live in Arizona or near the US border that's highly unlikely to happen.

File your AOS petition as soon as you are able, and relax. :thumbs:

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Just relax...your K1 expired the day you entered the USA, you already got married so you are safe. There is no set rule to file for AOS within the 90 days from entry however it is recommended to file as soon as you can. Good luck on your journey.

01/2006 - Filed k1(1st time)

04/2006 - Interview (1st time) denied

Waited, waited...... no review

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

04/2010 - Married

AOS Timeline

4/19/2010-Sent to Chicago Lockbox

4/26/2010-Received texts and emails 7th day

4/30/2010-Received NOA's(Hardcopies) 11th day

5/3/2010-Received ASC appointment notice(mailed 4/29/2010)14th day

5/7/2010-Walk-in Biometrics done(2 weeks earlier)18th day

5/13/2010-Case transferred to CSC

6/2/2010- Case received/resumed at CSC

6/18,6/22,6/23 AOS touches

6/28/2010- EAD production and touch on AP

6/29/2010-AOS APPROVED

7/2/2010- 2nd update on EAD production and touched on AP....

7/6/2010- Received "Welcome Letter" and AP document

7/12/2010-Received GREEN CARD and EAD
