A few final questions before mailing I-130 & I-485

Hello All,

Hope you had a wonderful 4th of July weekend!!!

Thank you for all your previous help, but i still do have some final questions before mailing my forms I-485 & I-13I:

I-485 PACKAGE:

1) Do I need to submit copy of Marriage Certificate with Form I-765? Some posts on VJ say Yes, others say No. Also, do I need to submit copy of the visa page in my passport with I-765 - it was NOT issued within the year from the date of current filing.

2) I-864:

- does it need to be notarized?

- Shall I live items #24 (b), (d), (e) blank if my husband is my only sponsor (his income is above poverty line and there are no co-sponsors)

- In item #25 he is asked to provide the figures for the 3 most recent tax years, does he have to do it even though we are sending the IRS transcript only of the most recent tax year? or 2009 adjusted gross income number is enough?

- Does my husband need to submit copy of his Birth certificate along with I-864 to prove citizenship or it is not required anymore?

3) How many copies of my G-325A are needed? Is one sufficient?

4) I have two I-94s one issued upon entrance to the US on J-1 visa, and the other one sent to me by USCIS when my status was changed from J1 to B2, do i send copies of both? (front and back)

5) On our Marriage Certificate there was made a mistake by a county clerk with regards to my country of birth. I have mailed the Affidavit to amend a Marriage Record to CA OFFICE of Vital Records. It's going to take 4 month to amend, shall I attach a copy of the Affidavit of Amend with the Copy of My Marriage Certificate (with postage receipts that it was received by the Office of Vital records) & an explanation letter to clarify the mismatch of my country of birth on Marriage Certificate and my Birth Certificate?

6) I-485 is signed & dated by both ALIEN & USC, right?

7) Do I need to enclose a proof of marriage and relationship with I-485?

I-130 PACKAGE:

1) Section C, part #17: does my husband mention his name here?

2) How many copies of my husband's G-325A are needed?

3) Does my husband need to enclose copy of MY PASSPORT OR BIRTH CERTIFICATE with this form?

4) Some instructions say to make a copy of FRONT & BACK of USC birth certificate. My husband has a certified copy of his B/C and there is nothing on the back, what to do? He has no passport

5) How much of proof of bona fide marriage do we need to submit?

6) I-130 is signed by both ALIEN AND USC? or just by USC?

1) Do I need to submit copy of Marriage Certificate with Form I-765? A lot your questions ca be answered by t he Guide; located on the top of the page. But No MC is required for the I-765 but since it is sent as apart of the I-485 which does require ur MC, I can see its easy to get confused. Yes, do send in a copy of your visa page, biographic page and back and front of you I-94.

2) I-864:

- does it need to be notarized? No

- Shall I live items #24 (b), (d), (e) blank if my husband is my only sponsor (his income is above poverty line and there are no co-sponsors)? Never, if you can, leave anything blank but since you answered (a) then ya dont have to use the others if he is the only sponsor. Please note that for questions 21, 26-29, type/write in "0" where applicable.

- In item #25 he is asked to provide the figures for the 3 most recent tax years, does he have to do it even though we are sending the IRS transcript only of the most recent tax year? or 2009 adjusted gross income number is enough? Yes you have to list the past three years' income. As far as transcripts are concerned, submitting 2009 is enough but if you believe that including the last three year's will help, by all means do so.

- Does my husband need to submit copy of his Birth certificate along with I-864 to prove citizenship or it is not required anymore? Since you submitted a BC along with the I-485, you dont have to as the I-864 and I-485 go hand-in-hand. We didnt incude one for the I-864, so to speak and we have our interview tomorrow without RFEs.

3) How many copies of my G-325A are needed? Is one sufficient? We included one each for the I-130 and one for you, the beneficiary with the I-485. So 3

7) Do I need to enclose a proof of marriage and relationship with I-485? NO. Just a copy of the MC is sufficient

I-130 PACKAGE:

1) Section C, part #17: does my husband mention his name here? We put N/A since the form already asked to mention me, the wife of the petitioner. You can list all children here.

2) How many copies of my husband's G-325A are needed? As previously mentioned, 2 of you and one of your husband for the entire packet; yours and his for I-130 and yours for I-485.

3) Does my husband need to enclose copy of MY PASSPORT OR BIRTH CERTIFICATE with this form? YES

07/05/13 - Interview letter sent/In-line notification

08/14/13 - Interview scheduled in Philly @ 1:30 pm APPROVED

11/07/13 - Oath Ceremony
