Hi everyone! freaking out... really need enlightenment :-)

I am a K-1 Visa Holder and we are in the process of applying AOS. My DS3025 form is dated July 13, 2009. My question is should i still need to do Medical Exam again? Or could i still submit my package with DS3025 signed by a Surgeon before the expiry ? I don't know if USCIS will consider it. We don't want to pay another 200$ for this.

Thanks so much for any inputs!!!

If you send only the DS-3025 then there is a strong chance you will get an RFE for an I-693 signed by a civil surgeon. If the "Vaccination history complete" box on the DS-3025 is not checked, then the chances of getting an RFE are 100%.

Here's how it works (this should also answer the question you posed in the other thread you started on this subject):

A medical exam is valid for one year, whether it was done by a panel physician abroad or a civil surgeon in the US. USCIS will extend the validity of the medical exam indefinitely IF the medical exam was not expired at the time USCIS accepted the AOS petition (i.e., the day the NOA1 is generated), and IF there are no class A or B medical conditions discovered during the exam. If the medical exam is expired when USCIS accepts the AOS petition then a new medical will be required. If there are any class A or B medical conditions discovered during the medical exam, and if the exam expires while USCIS is adjudicating the AOS petition, then a new medical exam will be required.

The chances of you getting an I-693 from a panel physician, and getting USCIS to accept your AOS petition before your medical expires are pretty slim. In order to avoid an RFE, you might be better off to go ahead and get a new medical done. I understand that it's expensive, and I sympathize. I paid for three AOS and three full medicals at the same time. :(

We went ahead and did the medical again to avoid a RFE. It's worth the peace of mind to me.

Beware of RFE's- if they don't get what they want they can and will deny you. (We were denied recently even though we thought we were giving what they wanted. Just a FYI so that no one ends up in our situation.)

Good luck to you, avoid RFE's if you can!

My DS3025 says incomplete too but I had the "Not all vaccinations medically appropriate" box ticked. Is this cause for concern?

Yep. Well.. not really "concern" but i would go see a CS just to check you had/have all your shots up to date. I did. $50 (what the CS charged me) and around 76 days later, I have a GC headed my way. No RFE's, no interview.
