Ok, so here is the responds from someone who lived through this...

"This is for everyone who says you have to stop working once your 90 Temp EAD expires"

NOT TRUE!!!!!!!!!!!

I..the immigrant got my Temp EAD at the Pacific Border Crossing in Blaine,WA on September 8th,2004

I applied for my SS# 1 week later.

I got a job 2 weeks later..

It's almost 2 yrs since that date and I am still working at the same job.

From the mouth of the Immigration officer..I can keep working even though my TEMP EAD expired as

my AOS had been filed and was being processed..[/font]

So, don't worry about, over analze it or stress about it..

I swear, I would have gone nuts if I couldn't work.. It was such a relief to get the EAD..

1ST NOA ARRIVED, I AM NOW OFFICIALLY AN ALIEN IN WAITING. (02/13/04)

One Month into the wait. (03/04/04)

Two Months into the wait. (04/04/04) My DF's B-day too!

Three Months into the wait. (05/04/04)

NOA 2 approved online!!! (05/01/04)

NOA 2 verification arrives in mail and petition off to NVC (05/07/04)

Packet 3 arrived in mail (05/17/04)

Faxed back Packet 3 checklist (06/02/04)

Four Months in the process: Got reciept in mail of Interview date (06/03/04)

RCMP check done and fingerprints done (06/13/04)

Medical done (06/23/04)

On vacation in Hawaii (June 25th-July 2nd)

Five months into the process: Just waiting for my interview date. (07/03/04)

Interview Date (07/16/04) @ 10am "APPROVED"

Six months into the process: Just preparing for the wedding and killing time until my work contract is done. (08/03/04)

Heading South Blaine POE via car: (09/08/04) DONE!

I have arrived!!!

Got my Temp EAD @ border!!

Go apply for wedding certificate: (09/08/04) 3 day waiting period... Now preparing for Saturday!

Final goal: Wedding September 11th, 2004 *DONE*

I AM MARRIED NOW!! WOO HOO

Sept. 14-17th Honeymoon in Lincoln City, OR

AOS Timeline

09/13/04: Applied for SSN *estimate time wait 2-4 weeks*

09/21/04: E-Filed my EAD/AP

09/22/04: Mailed in my AOS

09/23/04: Passed my written drivers test

09/24/04: Proud owner of a WA state drivers license

09/25/04: Received by SSN in the mail. Only took 12 days!!

09/25/04: Received NOA for EAD, online it says my AP has been received also but didn't get NOA.

09/27/04: Received NOA for AOS

09/27/04: AP "touched"

09/30/04: I got a job!!!! I start on Monday

10/27/04: RFE'd for forgetting to book Biometrics

11/08/04: Biometrics all done, paperwork back in the mail

11/10/04: Email stating biometric info recieved in NE and the wait is on again.

11/12/04: EAD "Touched"

11/13/04: Interview Letter arrived for I-485, Adjust of Status!

Woohoo! 49 days in process.

11/24/04: EAD "Touched"

12/14/04: AOS @ 11am in Seattle

12/14/04: Partical success, FBI check pending so no green card.

12/14/04: AP granted, I am going home for Christmas

12/14/04: EAD still pending but I can still work.

12/18/04: I am going back to VANCOUVER for the weekend!! Yipee!!

12/24/04: I am going home for Christmas to Vancouver!!

01/06/05: Permanent Residency Granted via Mail!!

01/07/05: EAD interview appointment (didn't need to go)

01/28/05: Still waiting for GC to arrive via mail

02/01/05: 363 days since I applied for my K-1

02/01/05: My Permanent Resident Card arrived today!!!

See you all in two years!!!!

May 2nd - Sent I-129F to Vermont

May 13th - NOA1

June 23rd - recieved RFE (IMBRA)

June 24th - Sent back RFE

June 27th - 7 touches

June 30th - touched

July 3rd - touched

July 10th - NOA2 notice via email

July 14th - NOA2 via snail mail

July 14th - petition mailed thru DHL to Asuncion, PY

Week of July 17th - Embassy received my petition

July 24th - beneficiary receives packet 3

July 27th - medical exam

Aug 7th - interview - approved :)

Aug 11th - picked up his visa

Aug 21st - purchased plane ticket!

Aug 30th - reunion day :)

I was one of the refused ones at JFK (April this year), the guy was rude and acted like he had never heard of such a thing. I tried to push him (just a little, I know...) but no luck with that either of course... Well, that was my experience with that...

Point of clarification - you can keep working even though your EAD has expired as long as your employer does not realize, or does not care, that your EAD has expired. It's the employer who is responsible for keeping track of your EA status, and it's the employer who pays a penalty if they fail to do so and get caught.

As the spouse of a US citizen, your failure to maintain EA status while continuing to work is overlooked with regard to your adjustment.

Keep in mind that other VJers have posted that they have been told just the opposite by USCIS officials.

Conflicting information comes out of the USCIS just as it does from VJ, especially on this topic where enforcement is not an area of USCIS concern. USCIS is only involved with processing the application, not with what comes afterward.

I still would not take any chances since you have nothing saying that you are authorized to work. I guess it is a personal justment call.

Traveled to Morocco on Aug 3rd, 2005

Got Engaged on Aug 16th, 2005

Left Morocco on Aug 19th, 2005

01-09-06 Interview Date (9am) We were not approved today, I guess we got a 221g of the damn S. Korea Police Certificate that Casablanca said we didn't need.

03/03/06 Turn in Passport at 9am

03/15/06 Visa Issued

03/31/06 Enter USA via JFK

05/15/06 Wedding for Visa

06/10/06 Mailed AOS papers

07/06/06 Biometerics Apt

07/15/06 My offical wedding day....I know .....:-)

07/10/06 Touched

08/25/06 EAD Approvel

09/01/06 EAD in Hand

09/26/06 AOS Interview (Recommend for Approval)

10-05-06 Received Welcome Letter

10-10-06 Green Card Arrived.

I guess it's is everyone's comfort zone.

But, since I got confirmation from the immigartion agent processing my AOS application and since

my employer was not concerned about it, I just kept on working.

I just wanted to let everyone know what I went through...
