I-864EZ Question about Poverty Line

Hello All!

The poverty line for 2 people is 16,500.

On my tax returns, my total income for the last two years was UNDER that amount. For the third year it was ABOVE.

However, my current salary that my employer is paying me is above the poverty line.

Do I need a co-sponsor?

My Wife has already received her K1, we are in the adjustment process. I got her over here with co-sponsors. I am just wondering if I need them now that I am employed again. I will call USCIS tomorrow.

sorry yeah I see that now .. I can't read.. umm yeah I am not sure.. I wouldn't see why you would need to .. maybe an infopass appt? I am sure someone can answer it here though.

If a co-sponsor isn't an option or you don't want to ask anyone yet, I suggest you write a clear, concise letter explaining the income shortfall in the past. Hopefully your employment letter states that your position is full-time, permanent, etc. If that isn't enough for them they will issue a RFE and then you can supply them with a co-sponsor.

What year(s) were you below the line?, or which year were you over if that's easier.

If your last year was over the line you should be fine..... if it was under then you may need a co-sponsor.... but like others have said file and see if you get a RFE for a co-sponsor....

Hard to say - you've provided here only very little of the total information that the USCIS case officer will review and consider. And even if you provided it all the case officer does have to make some judgements that may vary from person to person.

You are possibly marginal, it might be prudent to have a Joint Sponsor signed up should one be required.
