You don't have a legal marriage to him therefore the I-130 petition CAN NOT be approved as you lack a petition-able relationship.

I-485 requires and approved I-130 petition.

Until you get LEGALLY married all of your attempts will fail. USCIS doesn't care that you were unaware that the 6 month waiting period applied to your situation, remember ignorance of the Law is no excuse.

I understand that Bb4Ana. However, Im already married to him again and we have refile. Already, I appeal the decision of the first I130 to enable us time to get married and refile. I don't know if I should withdraw that appeal and follow the new one we filed cuz as u have said earlier, i know they will denied it anyway. What I don't understand is, why they say the fee is $110 on their website and they ask me to pay $585.

Well there might be a problem with having to pending petitions. I would send USCIS written withdrawal of the first petition as it has zero change of being successful.
