Hello every one,

Here is our status:

1) I-130 ( married daughter of USC )is approved and our priory date with NVC is very close to become current(12 more days)

2) I am on H1 Visa and my husband is on H4 currently living in U.S. and I-140 is pending

I am trying to self-prepare the adjustment of status for my family case, and have some questions:

1) Do I need to fill "I-864, Affidavit of Support" ? If so, can I sponsor our self since I have income through my H1 ?

2) Do I need to fill two separate form I-485 for me and my husband ? Or one for me with his name on it is sufficient?

3) Do I need to contact NVC? When I call them and give the immigration case number, it responds no case in NVC with this number. I understand that we do NOT need to go through consular processing, but I am confused when I read some posts mentioning first we should receive a letter from NVC.

Does anybody have a checklist of requirement for AOS in F3 category?

I am also in a similar situation in that I am here as F2 and my husband F1. His current employer is in the process of filing H1b for him but I just got a notice in the mail 2 days ago. A duplicate approval notice for F3 category was sent to me and it looks like I have already been assigned an alien number is that normal even if the case is out of the processing time. Please let me know how your journey has been. I am also under the impression that when you are adjusting here in the US your file is not sent to the NVC but kept at the USCIS and then sent the the local office you are suppose to complete the process with. What do you know about this. Let me know. Thanks so much a bit confused about this whole process.

1) the parent petitioner is the one who files the i864,

2) one adjustment of status packet each

3) yes, you need to let them know that you will be adjusting in country. usually married children cannot adjust in country, they go through consular processing. they don't know you are here legally on an H1 visa.

I also have questions regarding the NVC and adjustments of status from the information which was received on the approval notice it indicated that only consular processing applications are forwarded to the NVC and the AOS applications are stored and USCIS until the applicant becomes eligible to apply for AOS.

these are special cases because normally it would go through consular processing, but NVC does not know that the person is here legally working in the country, with an authorized work visa, and by that nature is able to AOS in country.

About the A#, I think so, that's the number your card will have.

In that case do I wait for notification of eligibility for AOS or schedule InfoPass when my priority date is really close to becoming current? Thanks for the information on the A#.

it depends, when was the petition filed, from what country are you? it depends on how long do you have to wait.

Received RFE in March 2010

Sent in requested Documents and received approval notice in April 2010

If you continue to be legal in the country at the time your priority date becomes current, just advise the NVC that you will be AOS here and not through consular processing, you will not need to send in payment or forms requested by the NVC.
