Hey guy, I'm sorry if I put this in the wrong place. Just wasnt sure where to put it. I have two questions.

#1

Do we get married first and then Alex can get his social security card/number? or can he get that before we get married?

#2

Do we have to pay AOS at the same time of getting his work permit? Or is that what the AOS is for? Just wondering on that b/c I'm having some issues coming up with the $1000. If it has to be paid all together, i can do it, would just prefer to do it another way if possible. lol.

Timeline

1) He can apply to get an SSN now, but it may be tough.

And if he gets one now it will be a restricted one , it will say "valid for work only with DHS authorization".

If he waits until after he gets the GC, it will be an unrestricted one.

2) When you apply for AOS, the work permit(i-765) fee is waived (Freeeee!!).

Make sure you enter the correct eligibility category though (there is a long list of them in the instructions)!

1. He can get it before or after marriage. If he's changing his name (hey it happens!) then it's sometimes harder but not impossible. He should apply around 2 weeks after his arrival to make sure he's in the system. His card will say "valid with DHS authorization" and the authorization will be the EAD or the GC. Once he gets the GC he can go back and have the "valid with ..." stuff removed.

2. When you file AOS you can also file the EAD (work permit) and AP (travel document) at the same time. Doing so the fees for the EAD and AP are waived. You CAN file for the EAD prior to AOS and you will need to pay the associated fee ($300+ can't be bothered looking). The EAD will only be valid until his I-94 expires (90 days after entry) and it takes about 60 days to arrive... so you're paying $300ish for a month of work... not worth it and not many people do it this way. If you're able to file AOS asap (inc the EAD and AP) he should have his work permit in around 60 days (same with the AP) and it will be valid for a year. Some people get their GC before they get the EAD which doesn't matter because the GC overrides it all.

So to answer your question 2 more succinctly, yeah, find the $1010 and file the AOS. it's cheaper and easier in the long run.

Your eligibility for the EAD if you file at the same time as AOS is C9. If you want to try for an EAD (and pay the price for it) before you apply for AOS, then it's C6.
