A friend of mine is on an athletic scholarship at a U.S. university.

She was worried about her GPA and dropped a class falling to 9 credits after consulting her student and NCAA advisors. This put her out of status right at the end of the semester. The school's International Student guy wrote a letter on her behalf explaining it was a misunderstanding and that she is a good student. Is she going to have an issue getting a new F-1?

The DSO should be able to help her request for reinstatement.

There was a misunderstanding with my arriving late to start school (wasn't actually late)

My then-DSO applied for a reinstatement, approved within a few weeks.

Reinstatement allows you the opportunity to regain valid F-1 status and have the mistakes you made corrected by USCIS. You may be eligible for reinstatement only if you:

* Are currently enrolled or intend to enroll for a full-time course load

* Can establish that the violation of status resulted from circumstances beyond your control

* Have not engaged in unauthorized employment

* Have not been out of status for more than 5 months

* Can document sufficient financial resources to pursue a full-time course load

* Do not have a history of repeated violations

* Are not deportable from the US on any other grounds

To clarify as well, she goes home for every vacation break and left at the end of the semester.

Oh.. hmm.. I don't actually know if reinstatement works when the person is not in the US (???)

prolly some big issue, then.

Stick close to the 'International Student Guy' - as he's got more stuff to do, quickly, if she's wanting to return to USA to further her studies.

By "International Student Guy" I mean DSO lol.

She normally goes home for vacation and has no other problems because she is on a full scholarship. Part of that scholarship is academic and she was worried about her GPA dropping below 3.0 and losing the academic portion (6,000 p/semsester).

Hopefully everything will be alright.

She has to be careful as F-1s on academic and/or athletic scholarships are under a lot of pressure to keep up good grades and performances. If she hasnt been "out of status" for a couple months, then she'll be fine. I do however question her tactics as we know that we (f-1 students) CANNOT drop below 12 credits without the permission of the DSO and also, why would she travel, knowing about her potential "out of status" issue? Hope it doesnt create a problem when she returns and tries to re-enroll.

Well, she is maintaining 12 credits with NCAA through a local university in her home country during the summer. The DSO wrote a letter on her behalf to take to the consulate and issued her a new I-20. The letter basically states that she is a good student and the dropping was an honest mistake.
