hello:

I desperate need help about which is the better way to write a letter to an immigration officer, my husband received a letter from them (I-291) saying that the application for residence had been denied supposedly because of marital fraud, all this four years after he applied. We got a lawyer who presented all the papers with proves and everything, and they gave him a receipt saying that they answer could take up to a year. My husband is going to loose his job, and we don't know what to do, every time we call the lawyer he said we have to wait, but I can not wait, so I need the best way possible to write this letter. I really appreciate any help you can give me.

It's a good thing that you hired an immigration attorney. This attorney now represents you and you can only hope that he or she is a good one. There is nothing you can do right now but wait. Even if you were to write a suberb letter, which I -- forgive me -- doubt you can, it would only end up in your file, and that's the best case scenario.

Do you really think a drone who works at the USCIS mail station will open and read your letter (I doubt they are even allowed to do that), then walk to an immigration officer and say: "hey . . . I think this is an important letter. Better drop everything you're doing and work on this file instead!"

There will be a time when an immigration officer is going to open your file, but that can take weeks, months, or, as they said, even up to a year. The best thing you can do it bug your own attorney to follow up on your case as much as possible. Your attorney may perhaps be able to make an appointment and speak directly in your behalf. You have no influence on USCIS's people, but you have influence on your attorney, as he or she is working for you.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . I wanted to approach my IO during my AOS period to request him to expedite a pending decision on our interview and despite writing two letters addressed to the IO, that were hand delivered and two failed infopasses to see him, I have come to the conclusion, that unless your letter has a barcode that can be scanned when you send it in, it will rarely reach the right person. Even if it does, they will show least interest. I wish I could offer you helpful advice. All I can offer at present is a prayer. Good thing you went through a lawyer. Unfortunately there are certain times in this process when its impossible to avoid an attorney. Good Luck!
