hi everyone, i have a few questions on the I-864 will be thankful for any help i can get. i am in the final stages of submitting theses files.

so i am the one filing for AOS, my wife is a US Citizen and my sister is a US Citizen. with that said i have 2 questions.

my sister is the joint sponsor so i sent her the form, on the form PART 1. There is a question that we are not sure about.

Basis for filing Affidavit of Support, am the sponsor submitting this affidavit of support because (Check only one box):

my sister selected I am the petitioner. I filed or am filing for the immigration of my relative.

but for some reason i think it should be I am the only joint sponsor. since is its my wife that filing the I-130.

based on the info above, do i have to file the I-864 does my wife have to file one also ?

sorry if this is a double post, having some net problem when i hist submit it did not work and the post was not listed

Does your sister live with you and your wife or not? I am assuming she does not live with you so...

Your sister is a co-sponsor so she checks box D, "I am the only joint sponsor"

Your wife (not you) must also complete a separate i-864. She will check box A.

If you and wife actually live together with your sister, then she is part of the household and must complete i-864A instead of i-864.

so my wife have to file the i-864A ? or the i-864 ?

Your wife files the I-864, as engineer21 mentioned.

also does it need to be signed in front of a notary public this just might be the most complicated form yet.

i just got the joint sponsor form back from my sister and she cant find her 2007 tax return. :help:

can i submit it like that? or does she have to call the IRS ?

Only 1 tax return is required, the other two are optional. Send what you have. Since you are sending actual tax returns, not transcripts, ensure you also submit a copy of any W2s and a copy of any other earning slips that are included in that tax return.
