i 864 help pls :(

Thanks if you could help... this is for i864 for spouse. Our i130 is approved.

USC's earnings are as follows..

2007- tax transcript - 13000 (no dependants)

2008- 9000 (no dependants)

2009- nothing

In 2010, from MARCH she is working as a temporary employee and her pay-stub show around 2000 per month (and after tax 1500) (no dependants)

Do these income qualify at all? I assume for checking against the poverty guideline, we should check against household size 2?

If we can't find a co-sponsor , how much bank balance will the USC be reqd to show.. and is it an avg balance for a period of time?

Current income is most important. Making 2000 a month, she makes 24'000 a year, which should be enough, but the concern is that you say it is a temporary job. How temporary? Ie will she still have it at interview time, might it become permanent? If so, you should be fine.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

if no co-sponser, then assets (cash in bank ) to cover 3 times 20K, or 60K in bank (that is rough calculation, btw)

2 ppl , per poverty guidelines, is 18K ++

pick one or the other.

1. do you mean to say that her present income don't count at all, but they go by tax transcripts?

2. also, suppose we get a co-sponsor and still fall short of the mark by say, 5k.. is this cash in bank average balance over a period of time.. or we can just make a deposit now to get the bank certificate?

The income level calculation is in the I-864, also explains the assets calculation.

so - for 15 000 of 'income - for 2 people (I am rounding that 18K thingie)

To include assets, must have some amount, divisible by 3, that makes up for the 'difference' in income..

So for 18,000 'level' - with 15,000 of income

18,000 = 15,000 + (x)/3

x would have to be 9,000, as assets are included at 1/3 of the assessed value.

the present income does count, some, but for 'totality of picture' on interview day, I think is some issue, without income for 2009. Sure, it can be explained with some letter of attestation, can be trumped by inclusion of a co-sponser/joint-sponser, but IMO, no income in 2009 is some issue for her.

re: 'when it was deposited into account' - this is some topic for much discussion, has been discussed before, much heat, some arguments. some ppl say it doesn't mater when it was deposited, some ppl think that a cash influx by a certain date is viewed as some evidence of visa fraud. The bottom line, as I understand it, is IF the money did not come from the beneficiary or the beneficiary's families, then the date of when it was deposited will not matter, as long as it's done prior to interview day.

There's a chance they might accept this, depending on whether the name of the employer clearly indicates the job is temporary. The safe bet is a joint sponsor who clearly qualifies.

Facts are cheap...knowing how to use them is precious...

thanks pushbrk, darnell, penguin.... i guess we will just file with the said three years income along with current pay-stubs. Hopefully whatever extra reqments they need, they ask at NVC stage itself and not at interview time!
