my case sent back to usa

Timeline

they send to me a letter said we dont belive your relation , and my passport have the visa in it and its had over it a stamp say cancled ????

i dont know why they do that , any way what the next step after it go back to state ????

what will happened and what the usa will do to it , is they can accept or what ?

if we need to marry each other how we can do that , and is there was a certain time after the i-129 refused by the embassy , or we can marry now

any help will be appreciated

06-15-2008 : my fiancee first visit to me ( stayed 3 weeks ) .

06-23-2009 : my fiancee secound visit me in Egypt ( stayed 6 weeks ).

06-28-2009 : ENGAGED

10-29-2009 : I-129F Sent

01-27-2010 : my fiancee 3rd visit to Egypt ( stayed 6 weeks ) .

02-09-2010 : travel with my fiancee to turkey in a vacation (5 days)

05-25-2010 : my fiancee 4th visit to ( stayed 2 months ) .

06-03-2010 :Interview Date .

Interview Result : approved ( ya right ! )

07-01-2010 : we got a letter had my passport and over the visa stamp says ( canceled without prejudice )!!

06-29-2010 : case sent back to usa !!!

07-07-2010 : MARRIED

01-12-2011 : the letter state the k1 case is expired , and ther was no prob to file back for any kind of visa

04-25-2011 : my wife here now visiting me in egypt for 2 and half mounth yayyyyyyyyyyyy

05-18-2011 : travel with my wife to malaysia in a 1 week vaction

06-14-2011 : register our marraige papers in cairo

It will go back to the USA. The service center can let it expire or send you a NOID where you can then write up a rebuttal. They can also send the case to the fraud unit. You might not want to marry so fast, you need to find out why they suddenly canceled your visa. Address all your red flags. According to your profile they made a home visit to your fiancee in the USA, that is not common. Usually it takes 1 to 3 months for a case to return.

4/30/2010-Received NOA's(Hardcopies) 11th day

5/3/2010-Received ASC appointment notice(mailed 4/29/2010)14th day

5/7/2010-Walk-in Biometrics done(2 weeks earlier)18th day

5/13/2010-Case transferred to CSC

6/2/2010- Case received/resumed at CSC

6/18,6/22,6/23 AOS touches

6/28/2010- EAD production and touch on AP

6/29/2010-AOS APPROVED

7/2/2010- 2nd update on EAD production and touched on AP....

7/6/2010- Received "Welcome Letter" and AP document

7/12/2010-Received GREEN CARD and EAD

The petition package will first go to the National Visa Center. After that, it will be sent to USCIS where they will make decision whether to reaffirm the approval of the petition, revoke the approval of the petition, or just let it expire without making any decision.

If they decide to reaffirm the approval of the petition then it will go back to NVC, and eventually back to the embassy, and you'll get another interview. This could take months, or even years.

If they decide to revoke the approval of the petition then your fiancee will get a notice of intent to deny/revoke the petition approval. She'll have a brief period of time in which to respond to the notice with a rebuttal. It is critical she responds, even if you decide to marry and pursue a CR1 visa instead. Not responding will allow USCIS to conclude that the consular officer's accusations are correct, and that you committed fraud when you applied for the visa.

If they decide to let the petition expire without making any decision then your fiancee is free to file another K1 petition. They could still send a notice of intent to deny based on the first petition, and she would still have to respond to to it.

If you decide to get married, then she can file a petition for a CR1 visa. She does not have to wait until a decision is made on the returned K1 petition. However, she must still respond if a notice of intent to deny is sent on the first petition.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Is your fiance still in Egypt with you now? If she is, both of you go down to the embassy and go into the US side and tell them that you want to get the form neccessary for you two to get married in Egypt. Also mention how you had the visa stamped in your passport and they cancelled it. See what they have to say about it. Ask them do they recommend you two getting married just to hear what they suggest.
