I-134 Affidavit of Support, Employment Proof letter

Before I send out another request to HR regarding this Proof of Employment letter, is there anyone here who submitted this as a supporting document to their I-134 Affidavit of Support where the salary stated is biweekly? I'm considered salaried non-exempt. The HR assistant said by law, they are only allowed to put my biweekly salary amount and not my annual (although, it was in my offer letter.) I tried to explain to her that the person reviewing my documents will compare this amount to the poverty guidelines and that's in annual terms.

To those who had the same situation, should I just send this letter instead of trying to convince them to change it the salary into annual terms? Was there any problems encountered at the embassy (specifically Manila, Philippines.) I would imagine the person reviewing has to do some calculations right?

Argh...such a small issue but it could be a potential bigger problem.

Timeline

The basic math shows everything is fine as long as the letter states you are FULL TIME. If you concerned include a copy of the offer letter and even type a brief explaination. Also, just include a copy of a paystub, it shows year to date. Dont panic about this. Just talk to your fiancee so he/she can explain it if there is a question....exhale, your fine

I don't think the DoS (or the USCIS) can dictate to a company what information it must provide in a letter supporting your qualifications as a sponsor. (A common example of this is that any savy company will not these days put in writing that a job is 'permanent'.)

Giving your biweekly salary should be quite sufficient - the case officer can easily do the math.

I know what you mean. I work in the Labor & Emp practice group of our firm and we know our stuff...but I would think this is something so minor. Anyway, I'll talk to her one more time and if she doesn't budge, I will have to attach my offer letter. It's so weird because when they were offering me the job, the salary was always referred to in annual terms but now that I'm working here...it will only be referred to in biweekly terms now? That's where I'm confused.

Thanks Dennis! I will have to do this then. I hate having to deal with HR over something so minor. I've already gone to her about this 3 times!

They only asked her for my recent ITR and W2's. I think it really depends on the consular or case to case basis. As i said, just send her your employment letter as well as your bank statement just in case.

You should have a tax transcript or past tax forms to support the anuaul income total, for the Affidavit of Support.

Fewer financial documents required. In the past, financial sponsors had to submit three years' worth of tax returns, plus six months of recent pay stubs and a letter from their employer. Now you’ll need to submit only one year's worth of tax return copies, nothing more. However, some attorneys recommend that you continue to supply as many documents as in the past, so as to leave no doubt regarding your financial ability.

Optional, easier version of form I-864. The new Form I-864EZ can be used by sponsors if all three of the following are true:

You were the person who filed the visa petition (Form I-130 and I-129F) on behalf of the immigrant.

Only one immigrant was included on the visa petition (for example, you're not also asking that the immigrant's children be brought to the United States.

Your salary or pension is enough to qualify you as a sponsor; in other words, you're not relying on your assets, or on other people to provide joint sponsorship.

Form I-864EZ only requires copy of past year's tax return and W2, but past 3 years recommended, also recommended but not required are copies of past 6 months pay stubs, and note from employer.

I-864EZ can be downloaded from USCIS from: http://www.uscis.gov/graphics/formsfee/forms/index.htm

The form can be filled out and saved for later use. Also there is no indication that a notary is required but I would still use a notary when signing the form.

This is a K1 visa situation - I-864 and the I-864 guidelines do not apply. (Unless, perhaps, the consular officer uses his discretion to follow them.)
