My wife came here in California on July 16, 2009 as K1 Fiancee Visa. Married within 90 days.

Then prepare the papers for I-485 AOS.

November 26 2009, filed I-485 AOS and EAD at the same time.

Received receipts and appointment for biometric scan on Dec. 1, 2009.

She had biometric scan on Dec 24, 2009.

On Dec. 9, 2009, received letter from USCIS, Notice of Transfer that AOS will be transfered in Laguna Niguel, CA. She received her EAD Card on the Feb 1, 2010. Then it stops. No communication from the USCIS, no letters, no appointment letter for interview.

WE are waiting for her I-485 AOS, interview or greencard. What are we going to do now? We keep calling 1-800 USCIS, also we've been to the field office to follow up but all they say is to wait within 45 days and do the follow up again. We even asked the USCIS field office if there is any discrepancies of the papers and they said theres none. We are now confused. How long are we going to wait? How long is the waiting period? Should we not do anything now since we've been to the field office and call 1-800 many times too and still got the same answer. Please advise. Thank you.

My husband and I are faced with a similar situation. We applied on 4-November-2009 and were transferred to California on 23-December-2009. We called the 800 number and they told us that there are no established processing times for AOS based upon family, and therefore we are not outside the window. We are trying to just be patient, but it is difficult. Hang in there.

You are right. But I am really confused though USCIS said "one case is different from the other". However, my wifes' friend who also came here in California, have K1 fiancee visa too. Her friend entered California August 2009. Of course they got married within 90 days. She filed or applied I-485 AOS and EAD on March 2010. She got her biometric scan on the following month. She was given a notice of approval on her greencard the next month (May 2010) and She got her greencard the other month, June 2010. Without having been interviewed.

Well, you are right its really difficult. Just keep on waiting without knowing what has been going on. Though we are not really in rush but at least anybody can tell us in the office what has been going on or is the papers on the progress. Because as they say it would be a 6 months processing time but our case is over due the processing time. I am frustrated!!!
