Timeline

I asked my husband about that (losing the passport and getting a new one), he said it probably wouldn't help any. The information is already in the system and the passport office may indicate something on the new passport. When I told him about this particular case he was like :blink: holy ####### :blink: . He's surprised about the denials but feels it was a long time coming considering the fraud situation in Egypt.

06-15-2008 : my fiancee first visit to me ( stayed 3 weeks ) .

06-23-2009 : my fiancee secound visit me in Egypt ( stayed 6 weeks ).

06-28-2009 : ENGAGED

10-29-2009 : I-129F Sent

01-27-2010 : my fiancee 3rd visit to Egypt ( stayed 6 weeks ) .

02-09-2010 : travel with my fiancee to turkey in a vacation (5 days)

05-25-2010 : my fiancee 4th visit to ( stayed 2 months ) .

06-03-2010 :Interview Date .

Interview Result : approved ( ya right ! )

07-01-2010 : we got a letter had my passport and over the visa stamp says ( canceled without prejudice )!!

06-29-2010 : case sent back to usa !!!

07-07-2010 : MARRIED

01-12-2011 : the letter state the k1 case is expired , and ther was no prob to file back for any kind of visa

04-25-2011 : my wife here now visiting me in egypt for 2 and half mounth yayyyyyyyyyyyy

05-18-2011 : travel with my wife to malaysia in a 1 week vaction

06-14-2011 : register our marraige papers in cairo

I would forget K1 all together if I were you. You may want to try for a CR1. I don't know how that stamp in your passport is going to affect any other visa attempts but you could try for a CR1. You'd have to get married in Egypt before filing for that one.

I don't think you have to wait to get married. You'll be filing a different visa so I'm not sure that you have to wait a certain amount of time before refiling after marriage.

Let me advise of one thing though about going the CR1 route...if they thought it was fraudulent already they might still feel that way after. You all will need to do some serious soul searching as to why they approved and then denied you. It is possible that they did a final review, maybe looked at some internet stuff and figured that your relationship wasn't valid.

That's a pretty bold azz move by the Consulate - one I've never seen before and they must have a damn good reason for doing it.

That *was* a bold move by the consulate. I'm wondering if we'll see more of that. It's basically slamming the door shut on trying to appeal a denial.

I see in the timeline in a's signature that USCIS did a home visit to the fiancee just after NOA2. I wonder if that had anything to do with it? The whole thing seems off to me.

I guess it couldn't hurt to try to file a CR1. They may deny again then you'd be out time and money but it's worth a try. After that I suppose someone would have to move to Egypt to make this work.

Don't even bother trying to 'lose the passport.' That information is there in their system and they have access to it.

Once my CR-1 was approved, they stamped and cancelled my student visa and tourist visa -- with similar verbiage -- I had from 2005 and 1999 respectively.

I had a B2 denial in 1997 and it came up in all three interviews thereafter.

Cancelled Without Prejudice: A stamp an embassy or consulate puts on a visa when there is a mistake in the visa or the visa is a duplicate visa (two of the same kind). It does not affect the validity of other visas in the passport. It does not mean that the passport holder will not get another visa.

I would still call the embassy. Specially since apparently it was approved at the interview, THEN the visa was actually printed. If there were doubts of a bonifide relationship, it would have never made it to production. Something must have come up AFTER the approval.

Home visit? that can't be normal can it?? when did home visits start for a k1 visa?

It's not common but it can happen for any type of visa if fraud is suspected.

Right and we don't know what the consulate/CO found after the interview that made them cancel the visa. We would all like to think our fellow VJ mates are all honest,etc. but we don't know their lives or what may have been dug up. Not saying that A is guilty of anything but we just don't know.
