Hi

Everyone on vj

im new here and i wanted to ask question?

I was living in states 10 years ago and i made a biggest mistake of my life. i was arrest shop lifting. I convicted this crime 10 years ago.

Now my husband has applied for K3 spouse visa, i have not told him abt my past so on DS 230 i said "no" when it said "have you been charged, arrested or convicted of any offense or crime?"

Now after my DS 230 was processed the nvc only asked me to send them my original birth certificate.

What should i do now at the time of the interview, should i tell them the truth and tell them that i made a mistake

when i filled the form DS 230.

HELP PLZ

IF you were convicted in the US there is a strong possibility that they found your records during checks. You have lied on your immigration forms. There is a high possibility of a LIFETIME ban based on your misrepresentation. It is not as simple as saying that you want to own up to your lie. I think you should start looking for a good lawyer and not base your future on advice from VJ

This will not be over quickly. You will not enjoy this.

IF you were convicted in the US there is a strong possibility that they found your records during checks. You have lied on your immigration forms. I think you should start looking for a good lawyer and not base your future on advice from VJ

i dont know how to do a good lawyer if you know any plz let me know....

also wht i belive is that if they found my records then my case should not have come this far, any way i am looking for a good lawyer. i hope its not too late.

If they haven't caught it now, you are from a country with additional background checks are routinely conducted. So if, by chance, they haven't found out yet, they will and that could be very bad for you. I STRONGLY suggest you contact NVC and ask them if you can send in an ammended DS230.

At the VERY least, you need to come clean at the interview to save your chances of being granted a visa.

i just called nvc and they said yes you can send ammended DS 230. tell me do i have to send them a covering letter explaining them that it was by mistake. what happens after that....

Yes, writing an explanation will help. Being honest through the rest of the process is very important. US consulate in Pakistan is well-known to do background checks on most people who go through them.

Don´t be afraid to tell the TRUTH, they will find out it eventually. So yes u will be prepared If they ask about it at the interview, tell them just the truth.

I was living in states 10 years ago and i made a biggest mistake of my life. i was arrest shop lifting. I convicted this crime 10 years ago.

Questions that I haven't seen answered:

How old were you when the crime was committed?

Since you state you were arrested, I'm assuming it was by the police and not a security guard, so if the police were called, did you go to court?

If you went to court, what, exactly did the judge say?

I ask this because if you were a juvenile, then the rules may be slightly different, especially if the judge said something to the effect of "if you attend these classes, this will be stricken from your record as long as you don't commit any other crimes while here/for the next five years, etc.".

I say this because if the records were stricken or sealed because you were a juvenile, then it's possible that there may be some leniency, or even no issues at all.

Just a thought, but still, your best bet is to talk to an immigration lawyer and present the full facts, including copies of all court papers if you have them.

answers to your questions......

i was only arrested by the police and was not taken to the court.

my arrest record has been destoryed due to its been 10 years..

So then it went something like this:

  • You stole something and got caught (aka "committed" a crime and the police were called).
    Note: Anyone can charge you with a crime, but only a court of law can convict you of any crime in the US.
  • The police arrested you.
  • The store owner/manager worked out an agreement where in exchange for you attending some form of classes and never doing that again, the charges would be dropped.
  • You attended the classes and never did any crimes of this nature again.
  • The charges were dropped.

Is this accurate?
