Hi,

I have an approved Family First Preference petition as the unmarried adult child of a U.S. citizen (my mother, who naturalized). The NVC has noticed my mother for Affidavit of Support, and a visa number is now available. I am pulling together the DS 230 packet now.

I was living in the U.S. for years on an E2 visa. The business associated with the visa failed last year (recession etc) and I left the country for a couple months. I then returned on VWP (I am a British citizen) and stayed the full 90 days. I spent a month out, then returned again on VWP. I was pulled into secondary for six hours, and was finally allowed to enter for one month to wind up my affairs. I was told I wouldn't be allowed to use the VWP again. I left after the month, and have been outside the U.S. since (6 months). I'm told it could take another 6 months for my immigrant visa to be issued.

Meanwhile, my mum isn't doing so well - experiencing anxiety, having panic attacks etc. What would my chances be of getting a B2 visa to come to be with my mum while we wait for the immigrant visa? Her doctor is willing to write in support of an application for a visa to be issued on compassionate grounds. Not sure if that helps.

It is not an obvious winner but no harm trying.

I agree. The chances of you getting a visa just to visit your mother are pretty slim given the fact that her condition is not life threatening and that you're already at the DS-230 stage at the NVC. But, it doesn't hurt to try.

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview
