Gringos/as living in Mexico, have any of you applied for residency based on marriage to a Mexican citizen? I`ve been checking the websites for INM and SRE and the only thing I can come up with is the link at the bottom of my post. I`m wondering if any of you have gone that route. If so, does that get you work permision too? I`m thinking that it doesn`t, but not sure. What I worries me about these requirements is point five in the "documentos" section. If I understand it right (maybe I don`t because sometimes things get away from me in Spanish), this route to residency may only be for disabled. Or maybe that document is optional? If no one here has tried to make use of this, can anyone with better Spanish than mine give me an opinion on whether I`m reading it right? Thanks, guys.

I know that it's a very complicated process and takes about 5 years. I have some information at home (I'm in Mexico now visiting my fiance) and I will try to remember to send you the link in a PM when I'm back. For the moment, I did find this:

IMMIGRANT

Immigrants are foreigners authorized to enter the country with the purpose of establishing permanent residency. Immigrants will be allowed to remain in the country upon satisfying various requisites and will be granted a permit for up to one year annually renewed for up to five years, provided they comply with the proper requisites established by the Ministry of the Interior. Upon completion of the five year period as an immigrant, the foreigner will be authorized as a permanent resident ("inmigrado"). Immigrants staying out of the country, more than 18 months in a continuous or non-continuous manner during the five year annually renewable period will not be granted the permanent resident status until a new five year period has elapsed thereafter. When such absences total more than 2 years, foreigners will lose their immigrant status.

Immigrant categories include the following:

8) Family dependent: foreigners married to Mexicans or those who have children born in Mexico.

If the marriage ends or the foreigner does not comply with the obligations imposed by civil law, such as alimony, the foreigner will lose this immigration status unless the foreigner already has permanent resident status.

It's not clear from this if work authorization comes with this or is a separate. Having been through the FM3 work authorization process in Mexico in the past, I know that it is also long and difficult - I had to be sponsored by my company.

Anyway, that's a start. Hope that helps!

Kitkat, I know that "Inmigrado" requires five years as a resident first- is that the five years you`re talking about? What I`m looking for is a way to get through that time. Actually, my understanding of SRE regs is that a spouse can apply for citizenship with two years` residency. Either way, I need to find a way to knock out that in between time. If the info you have at home pertains to that, I`d appreciate seeing it. By the way, this is my "Plan C"- "Plan B" is the employer sponsorship that you took, but I`m not holding my breath on that one. I have a pretty much infallible "Plan D", but it won`t be pretty. Good luck with your 129. You aren`t going to need to wait out a waiver after all this, are you? I sure hope not.

Yes - waiver after all this. :( But at least we are prepared and he should be going to his interview relatively soon.

On the inmigrado status, the part that refers to foreigners married to Mexicans falls under "inmigrado" status so it looks like from that info it is a 5 year wait. Employer sponsorship is a reasonable option is you can prove that you have skills that a Mexican cannot provide (same as work visas in the US). It's doable for trained ESL teachers, for example, for harder for other professional jobs because many companies have requirements prohibiting them from hiring foreigners. Anyway, hopefully I can find more for you when I'm home!

I was considering/investigating mexican citizenship before I started the K-1 process (and it still may be a possibility for me in the future). The office you want to be dealing with is La Secretaria de Relaciones Exteriores (not immigration). At least in Oaxaca, immigration doesn't deal with Naturalization. As I understand it, your two routes to Mexican citizenship are residency for 5 years or marriage to a citizen and residency for 2 years. Once you're a citizen you can work, vote, drive, etc. The paperwork for this process is pretty incredible (I've heard) so the FM3 plan might be best to get you living and working in the country. I was on a tourist visa while processing my FM3 for the first time, the tramite process took about 2 months.

Check out http://www.sre.gob.mx/tramites/nacionalida...nalidad.htm#III or the "codigo civil" for the law but best to visit an office or talk to a real person.

Good luck! Let me know if you find out an tricks! ;)

Try searching here as well: http://www.eslcafe.com/forums/job/viewforum.php?f=26

It's a forum for ESL teachers in Mexico - several of whom are married to Mexicans and have been through the process. I know I've read the details of what they went through so if you search a bit there you may find the true scoop.

Cassandra - 2 months for your FM3 - that's awesome. Mine took 9!

Kitkat- Sorry to hear you still need a waiver. !!Maybe they`ll give you "a time served expedite" for all the time you spent waiting for new regs or for helping out so many other folks in the mean-time (you`ve helped me on I2US too)!!

Cassandra- was your FM3 employment based? I`ll be needing the SRE if I file to naturalize, but I think INM covers visas. Yes?

Muchos thank yous, both. I have a little over eleven years in with a big corporation which has a plant in Queretaro. I`ve been talking to the personell dept there to see about transfering and still haven`t gotten anyone to say "yes" or "no". My profession could fall under mechanic, machinist, or welder depending on how you look at it and Mexico has plenty of all of them. My ray of hope is that I have a lot of experience with the specific equipment they use- big `ol German rotogravure presses, German and Italian copper and chrome plating systems. I just don`t know that`s enough or if it`s worth it for them to try pushing the point in order to get me in. As far as ESL, I`ve done it here as a volunteer and I enjoyed it very much. The problem is that I have no degree. Just might work out anyway and it could certainly be a decent side-line, especially if I naturalize. Fortunately, my wife has relatively good earning potential in Mexico and we already have a house. If I can get even a non-work visa for the first few years, it might be a good idea to spend my waiting time studying for licenciatura.

bdesj - a time served expedite is such a wonderful idea - too bad there's not a chance in hell for that!! But thanks for the kind words and thoughts.

I would still recommend searching on the esl site for the regs regarding naturalizing. Of course, if you can work out a transfer where they still consider you a US employee, that would be ideal! Good luck.

Glad to have found a Mexico thread!! I was wondering if anyone can help me find some timelines for a IR-1 Visa. Im just waiting for my case to be approved at NVC and sent to CJ Embassy. I want to know about how long for an interview date?? I can find many IR-1 timelines for mexico and it would really help me plan everything better if I had an idea.

Thanks for any help!
