Not big news but our packet arrived today at 1042 :) Yes Im that paranoid that just knowing its been signed for and received is a big relief! lol

Congratulations! It's big enough new when you're anxious. Now wait a few days and see when they cash your check. When they've done that you know your application has been accepted for processing and the ball is rolling.

Hello everyone. I have been watching closely all the cases going on right now. As for me, my lawyer will send my I751(waiver)on Monday 07/19/10 Will someone please INCLUDE me on the list for the VERMONT OFFICE.

Here are some Q's:

- when should I receive my first NOA

- when should I receive my BIO NOA

- how long to expect for approval

andres0603, I got my NOA1 about a week after USCIS recieved my I-751. I hope that helps. I am still waiting for my Bio Appt letter. Definately contact USCIS if you have not recieved the bio letter after 45 days from the date on the NOA1. There was issues with dup bio letters being sent out. Looks like that issue was resolved. May and June filers are getting their bio letters. Approval time varies.

This is very true Tom. There's a reason they recommend sending it in sooner rather than later....mistakes can be made that cost time, but at the end of the day USCIS will blame the applicant if the deadline is missed.

Inquisitive one, have you tried calling USCIS to explain the situation to them so they don't automatically send back your application and say you're out of status? I know you sent everything back plus the letter they sent you (hope you kept a copy of it), but I have a feeling they might try to give you a hard time so better to be prepared just in case they do.

Yes I called them on the same day I recieved the returned application. The representative on the phone says that on the phone they cannot lookup personal information and she refused to look up the case by A#. She said the only thing we could do was follow the instructions on the NOA. And we also had the option of scheduling an InfoPass appointment, though the earliest I could get one was 7/20/2010. So it didn't make sense to wait that long. So I just resent the packet the next day but with payment for only $545 . If anyone else is in similar situation and not sure if you can file jointly or separetely you might want to write one check for $545 and then include a second check for $80 for the second person's biometric. That might allow them to accept the application and cash the first check only in the case of not allowing the joint application. If you overpay they will not accept the application as in our case.

And we did keep the original copy of the NOA that was sent to us.

I'll let you know when I see the check is cashed. I'm hoping that will be sometime next week.

This is very true Tom. There's a reason they recommend sending it in sooner rather than later....mistakes can be made that cost time, but at the end of the day USCIS will blame the applicant if the deadline is missed.

In my defense... we had a 10 day family vacation / wedding to attend in the other side of the country. A lot of different family members pitched in to help pay for flights and lodging etc, because they wanted to meet our new baby, so I tried to time the I-751 filing such that potential interviews/biometrics appointments/correspondence from USCIS would not cause us to have to cancel our trip.

In hindsight, though, the amount of stress its caused leaving it till last minute was probably greater than the stress of dealing with any issue that might have come up, so in future I'd file early and be damned.

If the packet had got lost in the post, or returned to the wrong address, then I'd be royally screwed right now. So overall, lesson learned :)

Yes I called them on the same day I recieved the returned application. The representative on the phone says that on the phone they cannot lookup personal information and she refused to look up the case by A#. She said the only thing we could do was follow the instructions on the NOA. And we also had the option of scheduling an InfoPass appointment, though the earliest I could get one was 7/20/2010. So it didn't make sense to wait that long. So I just resent the packet the next day but with payment for only $545 . If anyone else is in similar situation and not sure if you can file jointly or separetely you might want to write one check for $545 and then include a second check for $80 for the second person's biometric. That might allow them to accept the application and cash the first check only in the case of not allowing the joint application. If you overpay they will not accept the application as in our case.

And we did keep the original copy of the NOA that was sent to us.

I'll let you know when I see the check is cashed. I'm hoping that will be sometime next week.

Oh yes, I hope you don't think I was picking on you. I just speaking generally about how we have to be so careful with USCIS when it comes to time sensitive stuff because they'll always stick the blame on us.

I'm really glad your application got back in time. Don't forget to tell us when you get your NOA1. :thumbs:
