We are prepping to file and I had 2 quick questions. Her 90 days started 7/16 as she expires 10/16. How close to that 90 days do we need to be? Do I have a few weeks leeway?

Actually, your daughter's 90days starts on 7/18. Remember, 90 days, not 3 months!!

If USCIS receive your package even 1 day earlier, they will send it back to you ;) !!

Cover letter for K-2

  • Copies of the green cards of mother and daughter.
  • Copy of the joint bank account statement.
  • A copy of our 2008 and 2009 joint US tax returns.
  • I-797C NOA and accompanying letter showing inquiry into separate green card expiration dates.
  • Copies of life insurance notices showing her mother as beneficiary.
  • Copy of our health insurance cards showing previous and current policies.
  • I-751 Petition to Remove Conditions on Residence form for daughter
  • Certified copy of Marriage Certificate showing my marriage to her mother (incl her maiden name).
  • Copy of current lease agreement for our residence in North Carolina.
  • Pictures of daughter and family members taken during the previous 2 years.

You can file any time within the 90 day window as long as USCIS gets the application before the expiration date of your card. If you can though, it's best to file earlier in the window because sometimes things can be omitted or done in error and your application will be sent back for correction. If that happens you'll have enough time to fix the problem and resend.

Your list looks good. Don't forget to include the application, the check and a copy of your green card front and back. :thumbs:

well, i got my package back, i didnt send the original I-751 (the signatures issue ), somehow i sent the copy. Also, they said i filed early, my green card will expire on 15/10, and they received my package on 7/16, i thought 90 days may be counted as 3 months( although some months are 31 days), anyway i will send it again next week and i will update. :bonk:

Oh dear. Well at least you have plenty of time to fix and resend. 90 days is 90 days. You count 90 days back from the day your card expires and that's when your window opens. :thumbs:

I noticed on past months that a few people didn't receive their NOA 1 for some reason....so who & when do you decide to call somebody to find out if they atleast accepted the package? Or do you have to just wait and hope you get the biometrics letter?

Thats exactly what I did. Except I had 1 day left :)

i think getting an NAO1 is pretty much mandatory, since that is the official extension letter. Don't go to Arizona without it...

and when they cash your check you can be pretty sure the ball is rolling.

Most people receive a NOA1 about a week after sending in their application but occasionally some people don't get one. The NOA1 shows that the application has been accepted for processing and it also acts as proof of extension on your conditional residence.

If for some reason your doesn't come in the mail after a few weeks you should definitely schedule an infopass to check on your case and get your passport stamped. If you don't do that and your card expires you won't have anything to show that you're still here legally.

The best way to know if they accepted your package is if they cashed your check. If they did that means they accepted it even if you didn't get the NOA1.

I think also that some people put their name on the lists and then never come back to update what's going on with their case. :thumbs:

I agree. If they cash your check the case is in the system.

Read the sticky at the top of the ROC forums or check the instructions for removing conditions. CSC and VSC are the service centers that have been processing the I-751's for a while now. :yes:

All “Removing of Conditions” petitions are handled and adjudicated by California or Vermont Service Centers.
