My fiance is in Fes. He had his interview April 26,2010. Our application was sent back for further review. Contacted the Senator not much help there. Was told it could take 120 days or more form the date (july 12) which the service center (vermont) received it before we hear anything but by then the application will have expired. Was told I should gather all my evidence, get all my friends and family and his friends and family to write statesments and send it all to the service center along with a rebuttle letter. I aslo was told just go back and marry there and File the CR-1..... The whole process is nuts...... His sister and brother went through the same process with no problems but they both married nonmuslim white americans ( sisters hubby converted just to marry her, but doesn't practice) and he only knew her for a couple of months.... We decided to go with both suggestions Hopefully the first will work and we won't have to spend the money for me to go back ( I have already been twice in the last 10 months)

Hi :) Sorry to hear about the mess & I am also hoping the bombarding of support letters will work. But our case still hasn't left Morocco after nearly 2 mths, so we are bombarding them there :) I think Vermont still sometimes reviews the cases even if they have expired...so INSHALLAH that happens for you guys!!! I'm in the same boat of the "what do i do now??" Don't want to plan a trip over & then the case be reopened or something....so the clock ticks on :clock: So looks like your 120 days will fall about mid-November...when were you thinking about going back to get married (if need be)?? And I know how frustrating it is to see everyone else seem to get through so smoothly, while we don't...very annoying. But I just keep saying...everything for a reason & as long as we are together that's all that matters!! Best of luck to everyone!!

Monica :)

my husband and i met online in Nov2008 and we married March 9,2009. I stayed 2 weeks that is all work would allow. Then as soon as i got back i started to search of how to do papers because i had no idea of what i was doing. We married because we love one another not for papers. Well I hired a lawyer and it was the worst thing i could have ever done. She did a K3 visa. Don't any one do K3 it is the worst. I was told it is in fact obsolete now. I know it was a mistake now. We got recieve date May 15,2009 and notice date of May 20,2009 for I 130 and we get reciept date of June 2.2009 and notice date of August 27,2009 for I 129. Then we get letter of interview dated Sept 5,2009 and interview is set for December 1,2009. I am there with my husband in interview time again I stay 2 weeks cause of work. We go to interview December 1 and they interview him and I. They play with us and say oh we may give visa maybe another interview. We get phone call we have another interview for December 10, 2009 then they say false relationship and send papers back for review using 221g. Lawyer did nothing to help. When i am back in US i talk with her she just keep tell me oh you must just wait. I didnt wait i have wait long enough. I make many phone calls and find i can do cr1 visa cause i have an approved I 130. So i file this and we pay fees and send first packet in end of Feb and second packet ready to send in first week of March. Just as I am ready to send this i get an email saying all has gone to the USCIS for review. So i dont even get to send second packet. Now we are told oh it will be 120 days it is now 5 months and 2 weeks and we are still waiting. We have been marry year and half and still apart. I was just there in June again to see my love. This wait is killing us. I have worked with both senators, send emails, letters to 6 different offices in white house and state goverment. I make phone calls so much now that one senator office say we will call you back. Only infornmation new i have is that they say we are in que for officer in USCIS. I need to know what else I can do. I have tried all i know. If you can help us plz do. I can give you more details if you contact me.

What expiration date are yall talking about? Is that the NOA2 date that's open for four months? Mine is coming up Sept. 5 and if we don't have a visa issued by the embassy by then (it's being reviewed or processed- we don't really know and they won't tell us, just saying visa cannot be issued at this time) the visa will then expire right?

Meghan,

Don't worry about expiration. The Consulates have the authority to extend expirations as they see fit. You have already had your interview. Try to be patient a few more days. I know it's hard.

Even if the consulate extends the petition to allow for the interview USCIS still declares the petition expired. Returned K1's are always expired out of CSC and VSC has been doing the dame lately. If you want to refile then you should jump start the process and refile

This will not be over quickly. You will not enjoy this.

Just wanted to tell a little of our story.

We have a CR1 interview on Tuesday the 24th. I am here in Jordan with my husband for this one.

He went for a K1 interview Sept 1, 2009 and our case was returned to USCIS. After talking with him and asking alot of questions here, we made the decision to marry and refile the CR1. I withdrew our K1 in mid-September. I was in Jordan on Oct 2 and we married the 6th.

The CO did not tell him a specific reason for our return of the papers, but seemed very displeased with our age difference (I am 14 years older than Moh). She told him there were better ways to get to the US than marrying me. It was a real mess!

Any way, at the end of November, I got an email that the K1 had been returned to USCIS. My withdawal letter was not processed! When I called they went ahead and took the info over the phone and took care of it. I was told it became null and void when we married and that it had expired already, but he went ahead and cancelled it officially for us. I got official notice of its cancellation in January.

I am not sure why, but at the time we filed, other CR1s were approved in about 3 months. Ours took 5! There were no RFEs or anything, just a long time waiting. Then we had only one RFE from NVC and it was because I didn't send a paper... easy to fix and we were approved. We had to wait a while for an interview date because the embassy is busy, but I don't think the old K1 caused any problems (unless that is why we were at USCIS so long).

Now we are praying things go well Tuesday and he flies home with me Sept 7. We expect AP, but really hope we don't get it. And I really pray the old K1 doesn't come back to haunt us! I think it only bothers me because we never knew the real reason she returned it. Age is NOT a valid reason, but I really believe that was her main reason.

I will let you know what happens!

They seem to be able to use any reason they want to deny K1s...because they expire so fast & don't get reviewed. And I hope u hear good news soon Meghan & Ally. I know its a crazy rough ride.

I am surprised you got all this information. I couldn't ever get any about mine when it was sent back. Maybe your senator is better than mine!!?!
