Hello, my Dear All

Today i called to embassy and the guy he told me that we transfer ur case to NVC on June 24 2010 and we also send u ur original documents and passport and also wedding photos he also told me that u can check ur status in NVC...

plz plz plz plz help i m feel really hurting....

Your visa was denied. The petition is being returned to USCIS (they send it to NVC first).

The reason for the denial should have been listed on the notice they sent you. It may be very brief, only quoting specific sections of the INA. For example, "section 212(a) blah blah blah". That information is important because it will specify, at least somewhat, why you were denied. Without giving any personal information, try to post exactly what the letter said and we'll try to help you figure it out.

There isn't anything you can do until the petitioner gets a decision from USCIS. They may decide to reaffirm the petition, which means you'll get another interview. They may decide to revoke the approval of the petition, in which case the petitioner should get a chance to file a rebuttal. Unfortunately, this process take can months or years. You just have to be patient.

Could there have been a missunderstanding when you called the embassy? While I would ordinarily agree with Jim, they would not have sent your passport away, that is yours, not part of the documentation that would be kept after a denial.

I would get your USC wife to call NVC and se if they have any info and if not, have her call them embassy for more info.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

(X) Section 212(a)(5)a: This application for a CR1 visa has been denied as there is no petitionable relationship between the applicant and the beneficiary. our Fraud Unit has reviewed your case and confirmed that this case lacks the familal relationship to qualify for a CR1 cisa.

that sucks dear my thoughts are with you :crying: I cant believe that they kept your passport at the interview only later to return it to you and say that you dont have enough viable relationship evidence to prove that yall are really married... uggggh You would of thought at the interview they would of known this and given you a chance to rectify it then. Sometimes I think they do things on purpose just to jack with our lives... I pray that you can get your application reaffirmed at USCIS and have a second interview... hey did your wife attend the first interview? If not... I would highly reccomend that she attends the next one if you can get it reaffirmed.... she might not be able to actually be there with you but you could take her passport to show that she is present... also... this is the time to not break down... but to start collecting evidence for your NEXT interview.. be positive :thumbs:

I'm so sorry this has happened to the both of you !! Have your wife get in-touch with her

local congressman and see if she can find out why they think your marriage is a fraud , so that

maybe you can satisfy them. Also ... This may be the time to contact an attorney !!

Keep strong and don't give up !!

If you've copied the information from the letter correctly, they suspect you applied for the visa primarily to seek employment in the United States. Section 212(a)(5)(A) deals with labor certification. Were you previously denied a work visa?

The warning statement at the end doesn't really apply to you. Section 221(g) has to do with not providing the necessary documentation or evidence required to obtain a visa. That section allows the consular officer to retain jurisdiction over the visa application while waiting for the beneficiary and/or petitioner to submit the requested documentation. You'll probably find other paragraphs which are not marked with an "X" where that would be applicable. It doesn't apply in your case because the consulate has already decided to return your petition to USCIS.

This is a balancing act. You asked for a visa based on marriage to a US citizen, but the consulate concluded there was no real marriage, and you are just trying to get to the US to get a job. You now have to wait to see what USCIS will do with the returned petition. If they reaffirm, then you're going to need much better evidence of a relationship when you go back for the second interview. If USCIS decides to revoke the approval of the petition then they'll send the petitioner a notice of intent to deny/revoke. It is critical that they respond forcefully to this letter with strong evidence that a "petitionable relationship" exists. They'll have a limited amount of time to respond, so they should start preparing their response well in advance.

It would help a lot if you and your spouse could work on reinforcing your evidence in the meantime. More visits together, more photos, and especially more evidence that you are actually married and trying to live as a married couple. Whatever evidence you provided before was not enough to convince them.

I am so sorry this happened to you. They gave you 2 interviews and kept your passport. You had every reason to believe that you would get your Visa. I will continue to pray for you and your wife but she needs to get back to Pakistan and spend some time with you. She has only spent 1 week in Pakistan during your whole relationship/marriage and that doesn't look good. She needs to be more involved in your case. She should have been calling DOS every week to check on your case but she wouldn't do that. If you are ever going to get your Visa she needs to take more interest in your case and stop saying her work keeps her too busy to come to Pakistan or to make phone calls.

Sorry I can't be of much help on appealing a visa denial. But this I'm sure of your gonna need more evidence ( as Jim said). And your wife has got to get involved , you can't do the appeal ! Does your wife have an account on VJ ? If not ask her to open one as I'm sure their are people that can tell her on what she needs to do. She can also contact an attorney.
