Hello guys does anybody here knows what do I need to do to cancel the AOS petition? I just got an REF on the mail last Monday, my wife and I have decide to cancel the AOS and move out of the States for some time. Do you guys know if when I cancel the AOS would we get our package back with all the documents we sent? we lost the fee obviously right?

You can submit a letter of withdrawal... you will get nothing back...

No such thing as an example letter, just write a statement explaining what you are doing and send it back to the address for the RFE... it is pretty simple....

Correct, but I would recommend getting it done to avoid any question that the request is legit.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

what happen if I don't send the withdraw letter before the 90 days I receive my REF? and my wife travel to her home country? would she have problems for future visa petition? do I have any problems?

If you don't respond to the RFE in time then the petition will be considered abandoned, and the file will be closed, usually "without prejudice". The same thing will essentially happen if you send the withdrawal letter, except that the reason for closing the file with be that the petition was withdrawn. In either case, it shouldn't affect her eligibility to get a future visa, though they may ask her about it at the interview.
