Hi All,

I have a few questions to as, but first I here is a lil bit about my situation.

I came to the US in 04 on a K1 visa got married and now have my 10 year green card it will exp. in 7 years time.

my husband and I are on the rocks and it is looking like it may end in divorce, I'm looking at going home to get myself back on track, but I would like to come back to the states maybe be in 6 or so months. Would like to know where I stand with my green card it's in my married name where would I stand if we divorce? if I could come back for any length of time if I wanted too using my green card? my passport is still in my maiden name...

if any one could help me with any of these questions that would be great.

22 Sep, 05 AOS approved awaiting Green card in the mail !!!

Received Green card... but i can't remember when Sorry

13 Mar, 06 passed GED.

8 Apr, 06 Started work !!

7 Sept,07 Sent off I-751 to remove conditional residence status.

(keeping our fingers crossed we don't get an RFE!!)

10 Sept, 07 I-751 delivered at 11:27 AM on in LAGUNA NIGUEL, CA 92607.

22 Sept, 07 Green card expired.

24 Sept, 07 Called bank to see if check had been cashed - it hasn't ! :(

29 Sept, 07 Cashiers check cashed !!! WOOHOO that is a load off my mind !!!

1 Oct, 07 Called bank to see if cashiers check had been cashed !! see above !!

1 Oct, 07 NOA 1 received in mail.

3 Oct, 07 Biometrics appointment received in mail.

20 Oct, 07 Biometrics appointment.

1 Dec, 07 Decision of approval

7 Dec, 07 Received letter stating that my green card is on its way... no interview for us !!

14 Dec, 07 Received 10 year green card in the mail

Done with USCIS til mid Sept 2017 (card exp. 12/7/2017) :oD

I'm sorry that your marriage is having a tough time..

Divorce should not affect your status/Green Card because you already have a 10 year GC.

How long have you been a Permanent Resident? you might be able to start the naturalization process soon..

You can file to change your name on the GC but of course it will cost some money.

You can leave the country and come back freely with the GC

BUT are you planning on moving permanently and want to come to the US every now and then?

The Permanent resident status requires you to maintain residence in the US.

Frequent absences from the US for 6 months or more will probably be raise a flag that you are not maintaining that residence.

I'm thinking I might stay in the US after the 6 months back home... I'm not sure maybe I'll make it a shorter trip... I have to save if I want to come back to the US and live on my own. I just wanted to know my options... could I still come back on my green card even if I go back to my maiden name?

You don't have to immediately change your name back after divorce. If you really want to change it, it is probably safest to also change your name back to your maiden name on your GC. But if you don't change the GC, make sure you bring documentation to prove the name change elsewhere.
