K1 and Tourist Visa (Mexico)

Timeline

I met a female in Jalisco, Mexico Feb 2010 and decided that we would date to get to know each other. I was scheduled to fly out there 2 times (Plane tickets purchased March and April) but had a massive heart attack (In March) and other complications while in the hospital that prevented me from traveling to Jalisco, Mexico the 2 times. While I was in the hospital she applied for a tourist visa to be able to come and see me here in California. During her interview for the Tourist Visa she was denied the tourist visa and told it was because she had been at her employer (BanaMex In Jalisco, Mexico) too short of a time (1yr). I was discharged in May so she flew out to Tijuana, Mexico and I meet her there for the weekend then went to Rosarito for 2 days. She then returned to Jalisco. I then flew out to Jalisco, Mexico this month (6/18 from Tijuana, Mexico) and returned today. During all this time she would call me to the hospital and I would call her at her home. We also exchanged texts. While I was in Mexic we decided we would get married soon (No date set but I would say in about 6 months or so). My question is if I file for the K1 would they deny it (because she filed for a tourist visa in Marh) or make a big deal because she had just filed for a tourist visa and was denied and now a K1 filing?

Started the IR-1/CR-1 Journey

9/11/12 - Sent I-130 Packet to LockBox via USPS

9/17/12 - Received Text and Email of USCIS Acceptance Confirmation

9/1712 - Received First NOA from local USCIS (Laguna Niguel) I-130 recceived and in process

9/21/12 - Received another NOA from local USCIS (Laguna Niguel) I-130 transfered to USCIS-NBC in Lee's Summit, MO...

2/7/13 - Received email/text that my I130 was approved.

2/14/13 - Received official NOA2 approval notice via mail.

3/21/13 - Called NVC to get Case Number. Case was input in the morning. They gave me my case number.

3/22/13 - Paid AOS and Beneficiary filled out DS-261 Choice of Address and Agent online.

3/27/13 - Emailed AOS (I-864EZ)

3/28/13 - Paid IV Bill Online and Beneficiary filled out DS-260 Online

4/9/13 - Emailed Civil Documents

Now waiting for interview date!!!

I have the same issue. From the information I obtained this will not prevent the K-1.

09-21-2010 Case# assinged

09-22-2010 AOS and IV bill generated.

09-22-2010 Paid AOS and IV bill.

09/23/2010 Both bills show paid. Printed cover sheets.

09/27/2010 Mailed AOS & IV package (fedex).

09-28-2010 Package received at NVC 9:32am (signed for by J.Desmond)

10-04-2010 AOS & IV docs in AVR system.

10-08-2010 SIF.

10-21-2010 Case Closed.

10-25-2010 Case sent to USEM.

11-02-2010 Medical. PASSED

11-08-2010 Interview APPROVED

hey u have a great love story there...i don t think that the refusual of the turist visa has anything to do vith fiance visa they may ask about it but she can just say the truth.the fiance visa is a special one, diferent of the turist one and is hard to be refused if u have hard evidence of the realtionship and u can suport her till she will be able to work.it will be ok. Ozzie when my wife applied for a tourist visa and got denied i read her paperwork and it says they cant apply again till six months. i do not think it will affect the K-1 but if possible hold off this the six months of denial to make sure everything goes well.
