I am new here. I married a beautiful Woman from Ukraine just over 2 years ago. My wife was still finishing up her degree and we recently filed

the I-130 and it was accepted March 18th

I have a concern with the I-485 petition of support.

I have read that they require three years of tax returns. At the present I only have two from the previous two years. My concern is missing the third.

I make a living from being an ebay powerseller. I have tons of paypal records (5 years worth), bank statements (5 years worth) etc... and earn more then enough money to qualify.

I wanted to know if anyone had advice or knew if this was enough or how tough they are.

As far as assets I do not own a home. The home idea was put off until my wife arrived and we made the decision together. We had planned to wait a couple of years before buying a home so that she had time to get use to being in the US and we can make a decision together as to where we would both be happy living.

I do have three cars. One is my wifes (in my name)that I had already bought for her. All cars are owned and two are high dollar cars and one is my work car (what I use to get my product to sell) that is only worth a few thousand.

I do not know if these assets will help or not but figured I would mention everything in hopes to find a way to make sure my I-485 is approved.

Any help is apreciated. I have been worrying about this for a while now

I-485 is not a petition of support but an application to register as a permanent resident (greencard). The I-864 is the Affidavit of Support that is used in support of an immediate relative's (spouse's) application for a immigrant visa or the I-485 "greencard" application. The I-864 requires one year of tax return and declaration of the previous two years income amount. If you are self employed, then three years can be submitted to show stability of income, etc...

If you are missing one year, you can request a transcript of any year you are missing, if you in fact filed a return for that missing year

FWIW, the I-485 is not used anywhere in the process with filing an I-130 petition to the lockbox in Chicago.

There's a few exceptions on this, usually centered around USCIS losing the casefile . There is also the Adjustment of Status process for K-3 visa holders, but is high likelihood that any I-129F that you file later for a K-3, will be administratively closed at NVC, so the 'route' on K-3 is unavailable to you, hence the 'need' for an I-485 is null and void, also.

I'm assuming you mean the I-864, yes?

*** moving to CR-1 forum, has nothing to do with K-3 visa ***
