Forgot to notify our address change

Hello,

I forgot to notify USCIS that we moved, because our old address is her dad's address, so we could still receive our mail there. I never sent I-865 nor AR-11. I have read on different topics here, that it could lead to serious problems, but that in facts USCIS was pretty tolerant.

I have to file I-751 in about 15 days.

I understood from other topics, that I should immediately file I-865 and AR-11, correct?

In this forms, they are asking our moving date.

So should I give the actual moving date (almost 2 years ago), or just tell them that we moved 10 days ago, in order to "comply" with their requirement of notifying them within 10 days of moving.

I would prefer not to lie and give them the actual date, but just in case, I wanted to double check with your opinion.

Also, my wife never changed her address on her bank accounts, because we live close to her dad's, so she has been picking up her bank statements there. We are in the process of calling her banks to do the changes, in order to use our bank statements as proof of living together.

Is this the right move to do? I am afraid that USCIS might find the fact that we are only changing her address on her bank statements now suspicious. Can they do inquiries on our credit reports/scores?

Just follow the procedures and go from there.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thank you for your quick answer, that's what I thought too.

How about my second question? We are only changing my wife's address on her bank statements now. Are we doing the right thing or should she just keep receiving her bank statements at her dad's? However, if we don't, we will not be able to use them as proof of living together.

Also, she never changed her address on her driver license, should she change it too?

Many people filed with the original date of moving and they never got into any trouble. If you lie about it, then you will get into trouble.

I agree with Bobby Umit. Lying should be avoided at all cost. Given the circumstances, I think USCIS should take a lenient stance since you were approachable through your dad's address.

I would change all your things to your current address - if there is ever a question of bonafides - sharing the same "address" for bills is one part of the puzzle. (as you are going through)

Just update and file - best you can do at this juncture.

USCIS understands that things happen and people forget to do things, just make it right and you should be ok.

I had a similar situation like yours, I never notify our new adress to USCIS, I was also receving all the mail to my old address (my dad's).

There was a gap of 8 months were we had no proof of living in our new address ( no lease,utility bills, nothing), what I did was: I included a letter explaining our living arrangements, telling them that we weren't really planning on staying in that adrress that long therefore we never notify them ( which was true), I also included the name of the landlord and her telephone # in case they wanted tp verify that we lived there.

We moved again at the end of 2008 but this time we did notify them about that move and that's when we starting receiving all the mail to this new address.

Our ROC was filled Dec. 28 and my husband 10 year greencard arrived on April 12th, Thank God the whole address thing was not a problem for us at all.

4/12/2010 Aproved! Card production ordered!

4/20/2010 Card received

Finally over!!! no more uscis until naturalization.
