Hi, I may have asked this awhile back when me and my husband were doing the K-1 but anyway, I have a question regarding the GC because I have read some have been questioned and given a hard time on re-entry with GC. I already have a GC, i travelled out of the US before my GC was released. I was on military sponsorship overseas because of my husband's orders. We are in japan right now. I travelled out of the US last february 18,2010. I think my GC was approved around 2nd week of march.

1)Will that be a red flag? I had my AP documents before I left.

2) We won't go back to the US not until March 2012, I don't think we'll be making trips to US while we're here. WIll they deny me re-entry when we go back?

** I am still on conditional residency coz we AOS from K-1, we will file for removing of conditions while I'm here in Japan**

3) When we go back to the US, i am unsure if it will be because of military orders because my husband's military contract ends on 2012 that's why we will be going back to the US by then. WIll that be a red flag when I try and go back to the US?

4)My husband and I have talked on maybe I should fly out before my GC expires, maybe by december 2011, I'll go back to the US already. Will I be scrutinized and denied entry?

5) My husband is military so we file taxes on time, but we do not have any other assets in US aside from his car, which I think is just his name. We don't own a house there or anything because of him being overseas and in the military. We have filed taxes this year as joint married, but I am not working so, it's all him, will that be a red flag as well?

The only thing I can think of that maybe ties me to US is being married to a USC, we have a joint account on a US bank, I have a GC but I'm out of the US since I'm on military sponsorship.

I just want to know if any of these things I pointed out may deny me of re-entry when I go back with him to finally live in the US. Also, I want to know everything I need to do legally before anything is too late. Any suggestions and experiences on the matter is gladly welcomed. Thanks!

thanks for the reply! I remember people also told me about that, and then I remembered when we come back he's not military anymore hehe so I kind of got concerned there, plus i don't know if there any new rules or something :) thanks btw hopefully, I get more light on the subject

Call military hotline they may have more info on it. If your on military orders have copys of the orders, military base over-seas is usually considered american soil even tho they are a guest in the country.

AOS was approved in 2 months and 8 days without interview.

ok, thanks.. i just really wanted to maker extra sure lol and will call that hotline maybe there's a change or whatever.. i'd rather keep bugging asking questions than be too confident and get denied lol thanks

You will not be denied entry. You and your husband were in Japan not on vacation but on orders by the U.S government. My cousin's husband was posted to Korea and Germany for almost 3 years and she moved there to be with him. They applied for I-751 and everything from there and when it was time to come back, they entered the U.S without anyone questioning her. They actually came back on a military plane and no one said a word about her being outside for almost 3 years nwithout an AP.

Seriously consider doing expedited naturalization on 319(b) right away - no lifting of conditions required if you're not in the 5-6 months range to do removal of conditions.

You will not be denied entry. You and your husband were in Japan not on vacation but on orders by the U.S government. My cousin's husband was posted to Korea and Germany for almost 3 years and she moved there to be with him. They applied for I-751 and everything from there and when it was time to come back, they entered the U.S without anyone questioning her. They actually came back on a military plane and no one said a word about her being outside for almost 3 years nwithout an AP.

Oh ok thanks so much, I did make sure to leave with an approved AP :) mine was approved feb. 9 and i left US around feb. 18

Seriously consider doing expedited naturalization on 319(b) right away - no lifting of conditions required if you're not in the 5-6 months range to do removal of conditions.

I got approved for my GC last feb.25, 2010 so the conditional status will expire on feb 2012.. how do i do the expedited naturalization? an early citizenship would be great considering they won't hire non-US professionals on the US bases here on okinawa.. It would greatly help me get employed if I was a USC already coz they prioritize USCs here in the bases.
