Hi Guys,

Thanks in advance for reading and/or replying to my post.

I am about to file for an AOS for myself and my daughter but my spouse does not earn enough to meet the requirements. I know I need a co-sponsor but I don't understand how many persons the co-sponsor has to cover.

Does the co-sponsor have to earn enough to cover just me and my daughter and his dependents (co-sponsor's dependents) or does he have to earn enough to cover my spouse,PLUS my spouses dependents PLUS me and my daughter PLUS their own dependents?

I'm totally confused so I would really appreciate if someone who has used a co-sponsor can explain how it works.

Timeline:

07/27/2011: Sent off AOS packet by USPS Express mail

07/28/2011: Packet picked up by USCIS

08/02/2011: Received text and email notifications

08/09/2011: Received NOA1 hard copies

08/26/2011: Received Biometrics Appt. Notice

09/19/2011: Biometrics Appt.

10/05/2011: Received text and email for interview

10/17/2011: EAD Production ordered.....FINALLY!

10/20/2011: EAD Production ordered.... Again???

10/24/2011: EAD Status Changed to EAD approval notice mailed out on Oct 21,2011.

10/25/2011: Received EAD Card....approval notice = EAD card :-)

10/26/2011: Applied for new social sec.....received card 10/31

10/27/2011: Applied for new DL.......received it 11/4

11/07/2011: Interview Day.........APPROVED!!!!!!

11/07/2011: At 6:00 p.m. status changed to CARD PRODUCTION ORDERED :-)

11/15/2011: Green Card in hand!

The co-sponsor's household size includes the co-sponsor, any dependents the co-sponsor supports, and the immigrants they are sponsoring - that's all. Your spouse and your spouse's other dependents are not included.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

I am an LPR and my wife's paperwork is being processed at NVC.I sent in my I-864 even though I had no job,the NVC said I'd require a co-sponsor,then they returned my own I-864 and asked me to send in proof of my bank balance in US.I returned the I-864 with proof,all this while my co-sponsor is still lingering over in sending his I-864.

Today when I called the NVC,they told me the file is complete and waiting to schedule the interview at Islamabad.

Is this usual?How come they have completed the file even though they don't have the I-864 from the co-sponsor?

maybe they are forwarding the file to the embassy who will decide if I need a co-sponsor.Is it right?

certainly not.....How did you come up with $54,600....do you already know how many dependents I have?

No. I took the 125% threshold for a household size of two (I presumed it was just you and your wife) and I multiplied it by three - the ratio of assets to income for an immediate relative of the sponsored immigrant, according to the I-864 instructions. :blush:

The law allows the consular officer to make a discretionary call on the "public charge" requirement at the visa interview, and also allows Department of Homeland Security to make the call with an AOS application. The consular officer will almost certainly ask for a co-sponsor at the interview.
