Hi

My UCS husband has just filed the I-130 on 15th June and we've just received our NOA1. I have a couple of questions. We got married after 5 months of knowing each other, I then left the USA to work through the CR1/IR process from the UK. We have lots of photos together as I just spent 3 months in the USA with him and we have email communication etc. Would the short amount of time we've known each other go against us in the interview, or is it just a case of continuing proof. He is coming to see me for a month in Aug and then again in Oct.

The second questions is to do with I-864 affidavit of support. My husband has his own business and the past tax year has just earnt over the poverty line by 3000 dollars. The previous 2 tax years he didn't. However he has over 100,000 dollars in stocks and owns his own house. Would this be enough to show support, or would we need a second sponsor.

I appreciate any advice.

Congratulations on your marriage and good luck on your journey.

To answer your questions.

1. It might come up at the interview. Beef up your evidence as much as possible. Be prepared for any extra questions or skepticism. Look at your relationship from the most negative perspective possible. Then find documents, pictures, chats, anything at all to counteract those negative points.

Or it may not come up at all. Just be prepared to answer and be happy if you don't have to. :)

2. From what you've said, I don't think you would need a joint sponsor. He can use any and all assets he would like to show he's able to support you at 125% of the poverty level. Assets and bank accounts are counted at 1/3 of their value, I think. Check out the I-864 instructions and form itself for more information. And I'm certain others will come to fill in, too.

Just one other question. Obviously we don't have things like joint bank accounts or joint rental agreements etc, because I don't live there yet and can't get any of those things without social security number. If all we have is email, skype logs, some letters, photos and evidence of him visiting me in UK as well (he's due to visit in Aug and Oct) do you think this will be enough?

Could they actually deny the application because we haven't known each other that long and would we be able to appeal.

I can't answer your last question, but you said he is going to visit in August or October.

DEFINITELY tell him to keep the boarding passes!!

They are evidence that he really visited you. I think I read somewhere that "time spent together is a strong evidence".

Take plenty pictures around town too and with your family together. That should help aswell.

He CAN add you to his bank accounts he just needs to have IRS Form W-8BEN (google it). He should have you listed as primary beneficiary on any life insurance policy he may have.

Me and my husband have the same situation,we've met a few years back but we're together for less than 1 year and we got married after 5 months of relationship just like you guys.The bad thing is that we didn't think to save old prove(like bills,receipts and things like that) we have a few emails and that's about it. :unsure: We got a few affidavits signed by friends and family because we do not have shared bank acc. nor proprieties.I was worried about the same things like you!We just filled out I 130 and sent it today!!!!You're like 1 week ahead of us! :star: Let me know what happends with you guys!Best of luck & God bless!!

I am in similar situation,can my husband add me on the bank acc. even though I am NOT in the US(I am in my home country,Romania)??Will he need my signature?

Yes he can. I wasn't even married to Anna yet and she was still in The Philippines when I added her to both of my banks!

Also, you can be added to his, Life insurance, Medical insurance (you may not get the benefits but you can still be added to it), 401(k) and any other assets that gets paid to the wife after death. Also don't forget the birthday and other greeting cards.

Form W-8BEN is for tax withholdings on foreigner's income through treaty benefits. How does this allow you to add someone to an account? It still requires a TIN....
