Can collecting unemployment affect spouse visa petition?

I am currently working as a full time employee. Lay offs are imminent in my company. It seems as if I will be laid off soon. I am tossing the idea of applying for unemployment after getting laid off. Would this affect visa petition for my wife in any way?

To give you a little bit of background: I have petitioned CR1 category visa for my wife. I am a US Citizen. A couple of days ago, I sent in DS-230 forms along with all the civil documents to the National Visa Center (NVC). If there is no mistake in documents, she will be given an interview date (in her country) in a few weeks.

Can they deny her immigration visa based on the fact that I am collecting unemployment?

I don’t want her visa petition to be denied because of me collecting unemployment. I would not even apply for unemployment if her visa application could be in jeopardy.

This economy and my likely lay off have put me in a very onfusing situation.

Any insight into my question will be greatly appreciated.

02-23-2010: I-130 NOA2 (Approved) in postal mail

03-09-2010: Received DS-3032 / I-864 Bill

10-05-2010: Visa Approved.

10-05-2010: Visa Received.

Collecting unemployment will not affect the probability of getting a visa insofar as you will not be denied because you are collecting unemployment.

It potentially creates an issue with the I 864 affidavit of support, although you have already sent in your affidavit of support, correct?

i don't know about this.

BUT

at the time when the NVC and embassy are processing the data they need to see that you can still support the person. that is why you need employment letters that say you are currently employeed and making XXX money.

so you probably need a joint sponsor if you get laid off and are no longer meeting the requirement.

i am not sure about this, but i think it would be safer to get another sponsor to help.

I cannot think of any reason why you should be worried then. There are many people here that have successfully petitioned a spouse despite lacking a job (often times students), as long as a joint sponsor meets the requirements. As a USC, you are entitled to collect benefits.

As long as the cosponsor meets the income requirements it should not be a problem unless you are really unlucky and get a tool of a CO that feels she may be likely to become a public charge... odds of this happening IMO are low... should be fine with Pop's in the equation
