K3 Visa-Name change from Maiden-Is it a Problem? Please Help

Hi everyone, Hoping I can get some help from the forum again. I am in the philippines right now and Marie and I are getting married in 5 days. My question is this- She allready has a passport,police records, and some other documents that are in her maiden name. When we get married we want her to use my name on the marriage document,K3,etc.... In short she does not want to keep her maiden name. She wants my last name. What kind of problem will this pose during our K3 application/process. What do we have to do to get all the required documents when using her new married name. Can we use the passport and other documents(in her maiden name) she allready has?. What do we have to do so she can use her married name during the application process or do we have to? Hoping I can get some info from the forum. I have gotten help from this forum in the past and am very grateful to those who have helped us so far. Maybe someone can help or point me in the right direction about this question also. Thanks -Gary

Jan-14-2006 - Asked Marie to Marry me. She said Yes- the next 10 days were heaven

Jan-24-2006 - Had to go back the the U.S. Wasnt a good day.

Aug-01-2006 - Second Trip to see Marie.

Aug-15-2006 - We got married, It feels so right!

Aug-24-2006 - Back home to the U.S. Again. Leaving this time was by far worse than the last.

Sep-03-2006 - 1 year since Marie and I met online

Sep-05-2006 - I-130 sent to Nebraska - Thanks to the help of the forum our Journey begins

Sep-18-2006 - NOA1 for the I-130 received in mail

Sep-27-2006 - I-129F sent to Chicago

Oct-04-2006 - NOA1 for the I-129F Received in mail

Oct-12-2006 - Email from USCIS - I129F transferred to California Service Center on Oct. 11th

Oct-18-2006 - Email from California saying they received my I-129F for processing

Nov-02-2006 - Email from CRIS(early afternoon) -I129F approved

Nov-02-2006 - Email from CRIS (late at night) - I130 approved

Nov-06-2006 - I129F and I130 NOA2 received in mail-Hooray!!!

Timeline

Your name on ht application for the K-3 must match her passport name. If you put her married name on the petition for the K-3, she will need to get a new passport with her married name on it. I would recomend that she use the time that you have to wait, to get all of her documents changed into her married name.

October 30, 2006 Arrived back in LAX with Melinda, were going to Disneyland!!!

November 6th, 2006, Melinda and I are back home in Winslow Arizona loving Life!

My wife took my last name when we married in Cebu back in April. When we visited the court a week later to get our official copies of the marriage license I found so many typos it look like a 6yo typed it up. After I ammended all the errors and resubmitted they had it corrected a few days later but it did take a couple of weeks to get certified copies of the marriage license. Then it took about 3 weeks for my wife to get her passport changed as the local government office that handles that required her to attend a siminar where they told a bunch of ladies about the sex trade and responsibilities and help they can ask for when they arrive abroad. They also showed them movies of abuse and my wife said it was very unsettling but a requirement of all philippinos marrying a foreigner. After she completed the siminar she took the certificate and was able to get her passport name updated, which is a new stamp that is signed by an official that shows that she is married and her last name is changed to mine. Then she applied and got her postal ID (like our drivers license in States) change a few days later.

All in all it added about 6 weeks of waiting to get all of that done and if we had to do it all again I would probably insist on her keeping her name for the sake of time and changing it later once here. So I would have to agree with Rob on this one having personally gone through this back in April.

The wife is very proud to have my name officially it just cost us 6 weeks and about $100 in fees and travel.

Where did you learn this? My wife was a K3 and we used her married name on all of the immigration paperwork from I-130 petition to the I-485 application to adjust status. All of her documentation from her native country was, still is, and will forever remain, in her maiden name.

Im petitining for my husband and my passport still has my maiden name on it. I have not officially changed my name at DPS. The lawyer used my married name on the 130 and 129 forms. Will this be a problem?? Is this ok or should I get a new passport?
