:crying: MY husband went to his appointment on June 21,2010 They told him he was banned for life because he falsely claimed his was a U.S. citizen when he was about 25 years old. This was with a differant marriage and she is the one that forced him to do it. Now myself and our children are going to suffer because of her. I am so mad :ranting: !!!! Does anyone out there have any suggestion that might help our situation? cant say that anything at this point will help BUT I want to help my husband and our family to be reunited.

Regardless of the actual details, you must get an immigration attorney to attempt to sort this out.

I don't think I or anyone else on VJ could say anything that would help this kind of situation.

Being banned for life pretty much means what it says. I don't know anything about the appeal

process but hopefully there is one and for that he definitely needs legal representation.

Band/banned (?) for life - I'm not sure what you can really do to overcome that. The fact that his ex 'forced' him to do it isn't likely to fly as an explanation. I'd seek an attorney and ask, but it seems like a dead end to me. This is something they take very seriously.

You are moving to Mexico ??

If there is no way to fight this then YES!!!

I would do about anything to be with my husband

He is the love of my life, my friend, the person that I depend on for moral support. Who out there could live without these things?

The people that would suffer the most would be our children(who are all U.S. citizens)

they would not have the quility of life that I grew up with and all of them have needs, From health to school.

I'm sorry about your situation. Laurel Scott is an immigration attorney that specializes in waivers for this type of situation (falsely claiming US citizenship). You may want to contact her and set up a consulation with her. Based on the specifics of your husband's case, she may be able to tell if he has a chance to fight the ban or not. Good luck to you!

The prospective attorney's list of questions might include:

Was there any crime being committed in the course of the impersonation?

Did the accused benefit from monetary gain in the course of the impersonation?

Was the accused coerced or threatened into this act of impersonation?

Was this his idea or due to pressure from a 3rd party?

Did the accused pose any threat to society in the course of the impersonation?

There may be some more relevant than others, but this may give you a general idea.

Falsely claiming to be a USC is a lifetime ban with no real chance to overturn it. You should consult an attorney and then look at moving to Mexico.

Undocumented Entry

I want to thank all of you for all of your suggesions. I did read the article you suggested and after reading it it looks like it would be to my benefit to seek a good immigration lawyer. The article made me look and gave me some hope as to being able to have my husband live with me in the U.S. and that there might be a way but I will need to have a lawyer to over come some of the issues at hand, because they are more aware of the laws than I.

Thanks again to everyone.....

I second the suggestion to contact Laurel Scott. She's THE ONE to do this, as waivers are what she does, exclusively day in day out. Within half an hour on the phone you will know for sure if she thinks she can help you or not.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

Good luck and keep us posted. I would contact the lawyer that JustBob suggested as I have seen her name many times here on VJ and she seems very good from what people have said.

Please post your outcome as it could be beneficial for other VJ members undergoing the same difficulties.
