It would seem unlikely if there is CIR that it would not include K1 overstayers.

There is also now CoR, not easy, but possible.

OK... It didn't work out. She apparently had a change of heart after she got her Visa. Does this make it harder for me the next time I apply for another K1 Visa.... and how long will I have to wait until I can apply again?

I was previously approved in K1 visa and travelled in the USA last December 2009, we did not continue with our plans to marry for personal reason so I went to fly back

in PH in January 2010, recently we decided to just finally move on and get married no matter what-- my fiance applied yet for another K1 for me, note: same petitioner. Last week we submitted our I129F with the waiver under the provision of IMBRA. We are just waiting for the reply from USCIS-- Hopefully, there shouldn't be any problem.

In any case-- I am sure you will still be able to file for the K1 visa with another alien fiancee as log as you include the IMBRAA Waiver. It is not a form but a letter coming from you, make sure it has to be notarized!
