hi i'm looking forward my father is willing to co-sponsor for my fiancee and my father file his income tax with my mother it means the house hold size is 3 people my father, my mother and my fiancee.

my question is my parents live with my sister at the same house my sister is married with 3 kids and file their own income tax, are they included with house hold size even though they file their own income tax?

you know what, manila embassy rarely accepts co-sponsor. u will be lucky if they will approve ur co sponsorship. do u have a job? what step are u in now? do u already have interview date?

Unfortunately, as mentioned by the previous poster, the Embassy at Manila may not accept a joint sponsor and will use that to deny applications. Please do not count on a joint sponsor. You can try, but be prepared instead to provide tha appropriate income.

if ur still in the process of waiting on ur NOA2, find a job. that was our problem back then but with God's grace my fiance blessed with a good paying job, he got his job March 17,2010 under probation and got permanent just recently June 18,2010. and were still on the process of waiting the NVC letter.

“Rarely accepts co-sponsor” or “lucky if” is not the best term. USEM, does accepts co-sponsor(s) on a case by case basis. for the K-1. Meaning it’s not infrequent or unusual, it greatly depends on the totality of the petition, circumstance of the petitioner and the relationship of the co-sponsor.

u can never tell if u will get approved or not, but better to be safe. thats why i said rarely accepts co sponsor, coz i heard some previous applicants didnt accept their co sponsorship and let the fiance find a way to show proofs of CURRENT SUSTAINED INCOME and told them "we dont accept co sponsorhip", and i knew one applicant who is my friend who just got approved who used co sponsorship its because the fiance recently graduated from college and just got his job for like a week before the interview.. thats why i cant say they dont accept or they accept.

no NOA yet like i said i'm looking forward just in case i need co-sponsor :) and i know manila embassy don't accept co-sponsor but sometimes they do, you will never know, co-sponsor is just my back up just in case we need it.

Is your father being claimed as a dependent by your sister? Is your sister or any of her kids being claimed as a dependent by your father on any tax return? Filing their own income tax has nothing to do with house hold size, unless someone is claiming dependents. So if your father has any dependents he will need to count them as part of the house hold size. Read the PG in deterring house hold size.

The reason USEM scrutinizes the petitioner with a co-sponsor is the I-134 is not legally binding and imposes no legal obligation on the joint sponsor to make good on his or her promises. Your more or less, put under the guidelines of the I-864 affidavit of support. Keep in mind if your successful with your petition time will come when you'll need to adjust status (AOS) and start the affidavit of support once more! If your income is over the the poverty Guidelines for 'your' income you will not need a co-sponsor.

I think sjr09 gave you the wrong question to answer. It is not if the father is a dependent on the Sister's tax return, is the Sister and/or any of her family members dependent for support on your father? If they are dependent, whether listed on the tax form or not, then they must be added to the household size.

To be a joint sponsor, use only your father, not father and mother. So he will fill out the I-134 for your fiance(e) and you will also need to fill out a separate I-134 for your fiance(e).

If the mother is working and her income is included in the tax records, it needs to be subtracted out of the tax records using only the father's income. He should provide pay stubs of current income in addition to three years of tax forms. He also needs to provide proof of being a US Citizen, US Nation or an LPR. So birth certificate or Green card copied on front and back.

You have already been advised that the COs at USEM will consider the totality of circumstances and can and have rejected the use of joint sponsors.

No, I did not give the OP “wrong question to answer“, it can be a relative questions about house hold size and co-sponsor. The OP may have changing circumstances with co-sponsor down the road (i.e.) to the sister, it can make a difference. I just chose to ask the question rather then add unnecessary comments that may not be informational, OP was about father being the only co-sponsor.

1) If the father and mother are filing their own taxes, then yes, it was the wrong question to ask. "Is your father being claimed as a dependent by your sister?" does that question make any sense when he is filing married jointly? The other way could make sense.

2) The OP clearly stated that the mother and father file their taxes together. Therefore the information I provided was necessary if the mother also contributes income.

Relax. It is a diificult topic to understand all the ins and outs.

1. my father and my mother filling their own taxes and thats a joint income tax without dependents.

2. my sister and her husband filling a joint income tax with dependents which is their 3 kids.

3. my father, my mother, my sister, her husband and 3 kids live in one house thats the total of 7 people.

4. my questions, if i needed my father to co-sponsor the household size will be 8 including my fiancee? or it will be 3 my father, my mother, and my fiancee?

you can get a true answer by calling NVC in washington DC they well explain to you? some country, yes they never accept co-sponsor, but Manila embassy they do accept. my friend she just get her k-1 visa and her 2 sister in the US was the co=sponsor of her fiancee.
