Sorry if this is a question that has been asked a million times. My wife and I would like to bring her daughter to the U.S. she is under 21. Can I petition her as my stepdaughter or does my wife have to petition her as a Green Card holder? Also, which would be faster??

Was your stepdaughter under 18 when you were married? If so, you (the USC) can petition her. I am filing my stepdaughter this way.

When your wife becomes an LPR, she can petition her daughter. Petitions filed by USCs are normally processed faster than those filed by LPRs.

Thanks! She's only 10 yrs old. My wife already has her green card....I just wanted to make sure i could still petition her as the USC. And also which was faste. Thanks again

You may petition her. It will be much faster. File for the I-130 with the required documents. Once the I-130 gets approved, the processing will be quick. In my case, as you can see on my timeline, we were not in a hurry. But if you want to be fast, it will probably takes 4-7 months.

I don't mean to hijack the thread but I have the same issue and thank God, i found this post. I just posted a while ago about me (as LPR) filing for my daughter's petition in Manila and while I was browsing for more infos, I read in one post that it takes years for the visa availability if LPR filed for it so I think I'll just have my husband file it since we meet the requirements. I'm sending our MC, my daughter's BC, G-325 (daughter and husband), I-130, fee..do we need to send pictures? Thanks and goodluck to both of us.

Was your stepdaughter under 18 when you were married? If so, you (the USC) can petition her. I am filing my stepdaughter this way.

When your wife becomes an LPR, she can petition her daughter. Petitions filed by USCs are normally processed faster than those filed by LPRs.

Hi, Markieboy, i am new here i have the same concern for my son,who was over 18 when i got married with my husband(USC). My son is 20 now and we would like to bring him from China. Question is that if my husband is still eligible being the petitioner as the stepfather for my son? Or we have to wait till my GC is available( my case AOS is till pending).

Ever checked with a layer in Las Vegas, who said my husband can be, well i checked relative policy which says he can not be one for the stepson who was over 18 when we married.

Appreciate for any of comments.

then you can't. he has to have been under 18 before you married his mom for you to file. she'll have to wait until she is a LPR to file for her son.

sorry I got confused with the OP, your husband can't because at the time you married him, your son was over 18. you will have to wait until you are a LPR and he has to be unmarried until he receives his GC as long as you are a LPR.

Hi,

I'm in the same situation and hopefully you can help me with questions I have.

I know what to do from the US side, but not sure how it works on the Philippines side.

Did your daughter need a Philippines passport to leave the Philippines?

Did you need any consent form from the biological father?
